The Ministry of Finance, under the Department of Revenue, has issued Notification No. 62/2023-Customs on October 28, 2023. This notification brings significant changes to the export duty on onions, amending the provisions set out in notification No. 27/2011-Customs, dated the 1st March, 2011. The amendment aims to exempt the currently applicable export duty on onions, and this change is set to be effective from October 29, 2023. Let’s delve into the details of this crucial development in the customs regulations.

Detailed Analysis

The Customs Act of 1962 grants the Central Government the authority to make amendments in customs notifications when deemed necessary in the public interest. In this case, the government has acted to exempt export duty on onions. This exemption applies to the export of onions with the HS code 0703 10.

In the amended notification, Serial Number 1 in the table of the original notification No. 27/2011-Customs, dated the 1st March, 2011 is re-numbered as Serial Number 1A. Just before this re-numbered entry, a new entry is added. The new entry reads as follows:

  • Serial Number: 1
  • HS Code: 0703 10
  • Description: Onions
  • Duty: Nil

This change means that effective from October 29, 2023, there will be no export duty applicable to onions with the specified HS code.

Conclusion

The amendment introduced through Notification No. 62/2023-Customs signifies an exemption of export duty on onions, providing significant relief to those engaged in the onion export business. This move is designed to facilitate and encourage onion exports, contributing to trade and economic activities. It is essential for stakeholders and businesses involved in onion exports to stay updated with these changes to ensure compliance with the revised customs regulations. The amendment comes into force on October 29, 2023, and is a step taken in the interest of the public and the trade community.
