Genuine Spices Vs Commissioner of Customs (Madras High Court)

The Madras High Court recently disposed of a writ petition filed by M/s. Genuine Spices against the Commissioner of Customs, focusing on the provisional release of an imported consignment. The core dispute centered on the classification of the imported goods, which the petitioner claimed were roasted areca nuts. The Customs authorities, however, refused to clear the consignment, asserting the goods were misdeclared and did not fall under that classification.

The impasse was fueled by conflicting laboratory findings. Genuine Spices supported its claim with a report from ABC Techno Labs India Private Limited, which had also led to the FSSAI issuing a No-Objection Certificate (NOC) for clearance. Conversely, the Central Revenue Control Laboratory in Delhi provided a report indicating the goods were not classifiable as roasted areca nuts, supporting the Customs department’s stand.

Despite the ongoing controversy, the petitioner approached the High Court challenging the Show Cause Notice and seeking the release of the goods on an urgent basis due to their perishable nature. The Court, recognizing that keeping the consignment in custody would not “serve the ends of justice,” decided to mould the relief and grant provisional release.
