Inder Singh Vs State of Madhya Pradesh (Supreme Court of India)
Material Facts
The appeal before the Supreme Court challenged the order dated 29.01.2024 of the Madhya Pradesh High Court, which had condoned the delay in filing a Second Appeal under Section 5 of the Limitation Act, 1963 and directed that the appeal be listed for admission and consideration of the stay application.
The dispute related to title, possession and permanent injunction concerning certain land. The appellant had instituted a civil suit claiming title based on an allotment order and subsequent correction of revenue records. The State contested the claim, asserting that the land was government land reserved for public purposes and denying the appellant’s possession.
The Trial Court dismissed the suit on 16.08.2013. The First Appellate Court allowed the appeal on 01.10.2015 and declared the appellant to be the owner of the suit property. The State’s Review Petition was dismissed on 30.09.2019 on the ground of delay. Thereafter, the State filed a Second Appeal along with an application for condonation of delay, which was allowed by the High Court.
