The Insurance Regulatory and Development Authority of India (IRDAI) has issued an Exposure Draft proposing amendments to the Insurance Surveyors and Loss Assessors Regulations, 2015, following the Sabka Bima Sabki Raksha (Amendment of Insurance Laws) Act, 2025. The proposals replace the existing three-year licence regime with a perpetual registration system subject to payment of an annual fee. The amendments also introduce provisions for grant of registration, transition of existing licence holders, revised fee structures, suspension and cancellation for non-payment of annual fees, new registration certificate formats, and revocation of suspension. Additional measures include replacing licensing terminology with registration, simplifying compliance requirements, reducing documentation for annual fee payment, removing the need for licence renewal every three years, providing transition arrangements for existing licence holders, and dispensing with IRDAI’s prior approval for training and seminars conducted by the Indian Institute of Insurance Surveyors and Loss Assessors. Stakeholder comments have been invited until 10 July 2026.

Exposure Draft on Proposed Amendments to the Insurance Regulatory and Development Authority of India (Insurance Surveyor and Loss Assessors) (Third Amendment) Regulations, 2026

1. Executive Summary

The Insurance Regulatory and Development Authority of India (IRDAI) proposes amendments to the Insurance Regulatory and Development Authority of India (Insurance Surveyors and Loss Assessors) Regulations, 2015 (“Surveyor Regulations”), in light of the changes introduced through the Sabka Bima Sabki Raksha (Amendment of Insurance Laws) Act, 2025 (“SBSR Act”).

The proposed amendments seek to align the existing licensing framework for the surveyors and loss assessors (“SLA”) with the revised provisions of the Insurance Act, 1938 and facilitate a seamless and transparent registration system while increasing operational efficiency.

The proposed changes relate to regulatory framework regarding:

  • Grant of new registration,
  • Transition provisions for existing license holders,
  • Manner of annual fee payment,
  • Suspension or cancellation of registration upon non-payment of annual fee,
  • Formats of Certificate of Registration,
  • Processing and other fee specification,
  • Omission of redundant processes and forms.

The amendments are intended to support:

  • Ease of doing business,
  • Simplification of regulatory processes,
  • Reduction of compliance costs,
  • Enhancement of operational clarity.

The Authority invites comments from insurers, surveyors, professional bodies, legal experts, policyholders, and all other stakeholders on the proposed amendments.

2. Existing Regulatory Framework and Legislative Changes under the SBSR Act, 2025

The statement of objects and reasons as per the Sabka Bima Sabki Raksha (Amendment of Insurance Laws) Bill, 2025 (SBSR Bill) provides that in order to accelerate the growth and development of the insurance sector for enabling it to cater to the growing needs of the economy, it is essential to introduce a series of forward-looking reforms in the insurance laws. The key objectives of the legislative reforms include:

  • To further accelerate the growth and development of the insurance sector;
  • To ensure better protection of policyholders;
  • To improve ease of doing business for insurance companies, intermediaries and other stakeholders;
  • To bring transparency in regulation making and to improve regulatory oversight over the sector.

The proposed amendments to the Surveyor Regulations seek to operationalize the legislative changes keeping in view the aforementioned objectives.

The licensing of insurance surveyors and loss assessors in India is governed by Section 42D and Section 64UM of the Insurance Act, 1938. The existing framework provides a license regime based on a validity period of three years. The SBSR Act replaces the validity period-based license regime with an annual fee payment based perpetual registration regime.

3. Key Amendments to Surveyor Regulations:

 3.1 Change in Terminology:

Amendments are proposed for replacing the words “license”, “licensing”, “licensed”, “renew”, “renewal”, etc. with appropriate words in line with the SBSR Act.

3.2 Grant of registration:

The Authority will issue a certificate of registration, instead of license, to SLAs henceforth which will be perpetual subject to payment of annual fee until suspended or cancelled by the Authority.

3.3 Transitory provisions for existing license holders:

The existing licenses are proposed to be valid till their respective expiry dates. The same will have to get converted into registrations in a timely manner.

3.4 Annual fee, other fee and payment provisions:

The proposed amendments revise the fee structure applicable to SLAs by introducing annual fee in addition to an initial processing fee, to align them with the provisions of the amended Insurance Act.

3.5 Suspension for non-payment of annual fee:

The proposed amendments introduce provisions enabling suspension of registration of SLA followed by cancellation in case of non-payment of prescribed annual fee, thereby strengthening regulatory oversight, ensuring accountability and enhancing market discipline. The provision for revocation of suspension has also been introduced.

3.6 Revised format of certificate of registration:

The existing license formats are proposed to be replaced with the formats for certificate of registration.

3.7 Ease of doing business measures: The proposed amendments incorporate several measures aimed at improving ease of doing business, including:

  • Removal of requirement of renewal of license every three years,
  • Introduction of clear transition provisions to ensure smooth migration to the registration framework,
  • Reduction of compliance burden to the SLAs by minimizing the documents to be furnished while paying the annual fee.
  • Removal of Authority’s prior approval to the Indian Institute of Insurance Surveyors and Loss Assessors for conducting training/seminar.

These measures are expected to reduce operational and compliance burden, facilitate service continuity, support regulatory simplification and enhance efficiency within the surveyor ecosystem.

4. Stakeholder Feedback:

The Authority invites comments from stakeholders on the proposed amendments. Exposure draft of the Regulations is as per Annexure 1. Stakeholders may submit their comments on the exposure draft in the format specified in Annexure 2. Feedback may be submitted at surv-reg@irdai.gov.in on or before 10th July, 2026.

This Consultation Paper is issued for public and industry comments.

Annexure -1

Exposure Draft  

Insurance Regulatory and Development Authority of India (Insurance Surveyor and Loss Assessors) (Third Amendment) Regulations, 2026

In exercise of the powers conferred by clause (x) and (xa) of sub-section 2 of Section 114A read with Sections 42D, 42E and 64UM of the Insurance Act, 1938 (4 of 1938), and Sections 14 and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), as amended from time to time, the Authority in consultation with the Insurance Advisory Committee, hereby makes the following amendments to Insurance Regulatory and Development Authority of India (Insurance Surveyors and Loss Assessors) Regulations, 2015, namely; –

1. Short Title and Commencement of the Regulations:

(1) These Regulations may be called the Insurance Regulatory and Development Authority of India (Insurance Surveyors and Loss Assessors) (Third Amendment) Regulations, 2026.

(2) These Regulations shall come into force on the date of their publication in the official Gazette.

2. Objective: The objective of these Regulations is to amend the Insurance Regulatory and Development Authority of India (Insurance Surveyors and Loss Assessors) Regulations, 2015, pursuant to notification and coming into force of the Sabka Bima Sabki Raksha Act, 2025 amending the Insurance Act, 1938 and also to increase operational efficiency.

3. In the Insurance Regulatory and Development Authority of India (Insurance Surveyors and
Loss Assessors) Regulations, 2015:

(1) The words “license” or “licence” or “licensing” shall be substituted with the word “registration” except where expressly specified in these Regulations.

(2) The word “licensed” shall be substituted with the word “licensed/registered”.

4. Regulation 2

(1) In Sub-Regulation (2), the phrase “renewal thereof “shall be substituted with the phrase “conversion of the licence into registration”.

(2) In Sub-Regulation (13), the words and symbols “, in short, SLA” shall be inserted after the first instance of the phrase “Surveyor and Loss Assessor”.

5. Regulation 3

(1) In Sub-regulation (9), between the phrases “… is eligible for grant of license” and “, shall grant the same…”, the words “and has paid the specified annual fee” shall be inserted.

(2) Sub-regulation (10) shall be substituted with “The registration granted shall remain in-force subject to the payment of specified annual fee until surrendered by the individual surveyor or suspended or cancelled by the Authority.”

6. Regulation 4

(1) In Sub-regulation (13), between the phrases “… is eligible for grant of license,” and “shall grant the same…”, the words “and has paid the specified annual fee” shall be inserted.

(2) Sub-regulation (14) shall be substituted with “The registration granted shall remain in-force subject to the payment of specified annual fee until surrendered by the corporate surveyor or suspended or cancelled by the Authority.”

7. Regulation 5 shall be substituted with

“Fee Structure:

a. Processing Fee: The non-refundable processing fee payable is given below:

8. Regulation 6

(1) The heading shall be substituted with “Procedure for issuance of certificate of registration to the existing surveyor and loss assessors (SLA) holding a license”

(2) Sub-regulation (1) shall be substituted with

“Any license issued before the date of notification of these Regulations shall remain valid till the date of expiry as mentioned on such license.

Provided that a license holder who has already applied to the Authority for renewal of his license before the date of notification of these Regulations, such application shall be treated as an application for conversion of the license into registration. The Authority on being satisfied that the applicant is eligible for such conversion and has paid the annual fee specified in Regulation 5(b), shall grant the registration in Form IRDAI — 2 — LF or Form IRDAI — 4 — LF, as the case may be, as specified in Schedule II of these Regulations.

Provided further that after the date of notification of these Regulations, the holder of a valid license shall make an online application to the Authority along with the processing fee as specified in Regulation 5(a), before the date of expiry of that license. Such application shall be treated as an application for conversion of his license into registration. Upon satisfying the specified criteria for such conversion and has paid the annual fee specified in Regulation 5(b), the Authority shall grant the registration in Form IRDAI — 2 — LF or Form IRDAI — 4 — LF, as the case may be, as specified in Schedule II of these Regulations.

Provided further that if a license holder fails to approach the Authority as per second proviso above, then his license shall cease to remain in force. In such cases, the Authority may, if satisfied that undue hardship would be caused otherwise, accept an application for conversion of license into registration, submitted within 6 months after the date of expiry of such license along with an additional late fee of seven hundred and fifty rupees. The Authority, upon satisfying itself that the applicant meets the specified eligibility criteria and has paid the annual fee, shall grant the registration in Form IRDAI — 2 — LF or Form IRDAI — 4 — LF, as the case may be, as specified in Schedule II of these Regulations.

Provided further that if a license holder fails to approach the Authority as per third proviso above, the license shall cease to exist. To obtain a new registration to act as SLA, an individual may apply under Regulation 3 after enrolling afresh under Regulation 17 and complying with the requirements thereunder. Similarly, a corporate surveyor, in this case, shall apply directly for a new registration under Regulation 4.” Sub-regulation (2) shall be omitted.

(3) Sub-regulation (2) shall be omitted.

(4) In Sub-regulation (3), (4) and (5), the words “renewal”, “renewal of license” and “renew” shall be substituted with “conversion”, “conversion of license” and “convert” respectively.

(5) Sub-regulation (6) shall be substituted with “The license so converted into a registration shall remain in-force subject to the payment of specified annual fee until surrendered by the SLA or suspended or cancelled by the Authority.”

9. Regulation 8

(1) The heading shall be substituted with “Procedure where conversion of license into registration in terms of Regulation 6, is refused”

(2) In Sub-regulation (1), the words “application for renewal of license” shall be substituted with “conversion of license into registration”.

(3) In Sub-regulation (2), the words “of license” shall be omitted.

(4) In Sub-regulation (4), the words “license renewal” shall be substituted with “license conversion”.

10. Regulation 9 shall be substituted with

“Procedure for payment of annual fee by registered Surveyor and Loss Assessors and related matters:

(1) Every registered Surveyor and Loss Assessor (SLA) shall pay an annual fee as specified under Regulation 5(b), for every financial year, between 1st January and 31st January of the preceding financial year, along with the following documents to the Authority:

(i) Form 11 and Form 12 for the preceding financial year

(ii) Audit report and financial statement of preceding financial year (for corporate surveyor only)

(iii) Duly filled Fit and proper format

(iv) Any other document as may be specified by the Authority.

Provided that applicants granted a registration under Regulation 3 or Regulation 4 or Regulation 6 during the period from 1st February to 31st March of any financial year, shall pay the annual fee for the immediately succeeding financial year in addition to the annual fee payable at the time of grant of registration for the ongoing financial year.

(2) Any wrong particulars or false document/declaration furnished at the time of payment of annual fee may lead to regulatory action (penalty/suspension/cancellation, etc.).

(3) Failure to pay the annual fee within the time period specified in sub-Regulation (1) shall lead to automatic suspension of registration under Section 42D(6)(v) of the Act. Such SLA may apply to the Authority for revocation of suspension in FORM — IRDAI — 5 — RF as specified in Schedule II of these Regulations, along with the documents specified in sub-Regulation (1) above and fee as per Regulation 5(c), within three months from the date of automatic suspension failing which the registration shall stand automatically cancelled. Such automatic suspension/cancellation shall not require the Authority to follow the procedures specified under Regulation 23 and 24.

(4 If the Authority decides to revoke the suspension of an SLA in Clause (3) above, he shall be required to pay the annual fee specified under Regulation 5 before such revocation; else the registration shall be cancelled under Regulation 24.

(5) An SLA whose registration is cancelled as per Clause (4) above may apply to the Authority for grant of new registration under Regulation 3 after enrolling afresh under Regulation 17 and complying with the requirements thereunder. Similarly, a corporate surveyor, in this case, shall apply directly for a new registration under Regulation 4.”

11. Regulation 15

(1) Clause (b) of Sub-regulation (1) shall be substituted with “Post-registration training may be given by the Institute with different modules of training being offered for various departments provided that such trainings, seminars and workshops of the Institute shall be in accordance with the Board approved policy of the Institute.”

(2) Sub-regulation (4) shall be substituted with “In case the Institute does not comply with the decision of the Authority within 15 days, the Authority may then issue the registration to the applicant on merits of the case without the accompanying membership of the Institute, and such registration shall be treated as in compliance with Section 64UM of the Act.”

12. Regulation 19

(1) In Sub-clause (c) of Clause (1) of Sub-regulation (1), the words “license number and period of validity” shall be substituted with “license number with its expiry date OR registration number, as the case may be”.

(2) In Sub-regulation (2), the word “license” shall be substituted with “license/registration”.

13. Regulation 23

(1) The heading shall be substituted with “Suspension of license/registration for reasons other than non-payment of annual fee”.

(2) In Sub-regulations (1) to (5), the word “license” shall be substituted with “license/registration”.

(3) In Clause (c) of Sub-regulation (1), the phrase “or obtaining registration” shall be inserted after the phrase “renewal thereof’.

(4) In Clause (c) of Sub-regulation (1), the phrase “issue or renewal of such license” shall be substituted with “date of registration”.

14. Regulation 24

(1) In Sub-regulations (1) and (2), the word “license” shall be substituted with “license/registration”.

(2) Sub-regulation (3) shall be substituted with “A surveyor whose license/registration has been cancelled for any reason other than automatic cancellation under Regulation 9, may submit an application for issuance of new registration, after the expiry of one year from the date of such cancellation. An individual surveyor shall apply under Regulation 3 after enrolling afresh under Regulation 17 and complying with the requirements thereunder. Similarly, a corporate surveyor, in this case, shall apply directly under Regulation 4.”

15. Regulation 25

In the heading and in Sub-regulations (1) to (5), the word “license” or “licence” shall be substituted with “license/registration”.

16. Regulation 25A

In the heading and in Sub-regulations (1) to (5), the word “license” shall be substituted with “license/registration”.

17. Regulation 28, the words “and renewal” shall be omitted.

18. In Schedule II, FORM — IRDAI — 2 — LF and FORM — IRDAI — 7 — LF shall be replaced with the FORM — IRDAI — 2 — LF specified in Schedule I of these Regulations.

19. In Schedule II, FORM — IRDAI — 4 — LF and FORM — IRDAI — 8 — LF shall be replaced with the FORM — IRDAI — 4 — LF specified in Schedule I of these Regulations.

20. In Schedule II, FORM — IRDAI —10 — LF shall be omitted and FORM — IRDAI — 5 — RF, as specified in Schedule I of these Regulations, shall be inserted.
