The Food Safety and Standards Authority of India (FSSAI) has issued a new directive under Section 16(5) of the Food Safety and Standards Act, 2006, withdrawing its previous order dated January 20, 2022, regarding the disposal of used cooking oil (UCO). The 2022 order had set a provision that cooking oil containing more than 25% Total Polar Compounds (TPC) should not be topped up with fresh oil, a measure aimed at ensuring food safety. However, this provision has now been removed following a review of the available testing protocols and enforcement challenges. The withdrawal order, dated August 5, 2024, was approved by the competent authority, signaling a change in the regulatory approach to managing UCO. All Food Safety Commissioners, Food Business Operators, and Central Designated Officers of FSSAI have been notified of this update, with instructions to adhere to the revised guidelines. The removal of the earlier provision may have significant implications for food safety practices across the country.

ORDER

Subject: Directions under Section 16(5) of Food Safety and Standards Act, 2006 regarding disposal of Used Cooking Oil (UCO).

FSSAI Order No. RCD-18/1/2021-Regulatory-FSSAI-Part(2) dated 20th January 2022 pertaining to the matter mentioned in the subject above stands withdrawn with immediate effect.

2. This issues with the approval of the Competent Authority in exercise of the power vested under Section 16(5) of Food Safety and Standards Act, 2006.

ORDER

Subject: Directions under Section 16(5) of Food Safety and Standards Act, 2006 regarding disposal of Used Cooking Oil (UCO).

Reference is invited to FSSAI Order No. 1-2/SteWO&F/Notification n(11)/FSSAI-2018 dated 30th January, 2019 on the subject mentioned above. These orders, inter alia, provide that the cooking oil having developed Total Polar Compounds (TPC) of more than 25% shall not be topped up with fresh oil. This provision has been reviewed keeping in view the available testing protocol and related enforcement issues.

2. In view of the above. it has been decided to remove this provision with immediate effect.

3. This issues with approval the approval of the Competent Authority in exercise of the power vested under Section 16(5) of Food Safety and Standards Act, 2006.
