Draft Food Safety and Standards (Food Products Standards and Food Additives) Amendment Regulations, 2026
The Food Safety and Standards Authority of India issued draft amendments to the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 through a notification dated 26 February 2026 under powers granted by the Food Safety and Standards Act, 2006. The proposed amendments primarily update references relating to packaging and labelling requirements across multiple provisions of the regulations. The draft changes replace references to the earlier Food Safety and Standards (Packaging and Labelling) Regulations, 2011 with the newer Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020. The amendments also revise several clauses to replace the term “labelling” with “labelling and packaging,” and remove certain outdated provisions. These changes affect various food product standards, including provisions relating to sweeteners, beverages, and other food categories. The notification invites objections or suggestions from stakeholders within sixty days from the date the Gazette copies are made available to the public before the draft regulations are finalized.

No REG-11015/1/2024-Regulation-FSSAI.—The following draft of certain regulations further to amend the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, which the Food Safety and Standards Authority of India proposes to make with previous approval of the Central Government, in exercise of the powers conferred by clause (e) of sub-section (2) of section 92 read with section 16 of the Food Safety and Standards Act, 2006 (34 of 2006) is hereby published as required under sub-section (1) of section 92 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft regulations shall be taken into consideration after the expiry of the period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public.

Objections or suggestions, which may be received from any person with respect to the said draft regulations before the expiry of period so specified, shall be considered by the Food Safety and Standards Authority of India.
Draft Regulations
1. These regulations may be called the Food Safety and Standards (Food Products Standards and Food Additives) Amendment Regulations, 2026.
2. In the Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011, (herein after referred as said regulation), –

“Provided further that if sweetener has been added as provided in Appendix A, it shall be declared on the label as per schedule II of the Food Safety and Standards (Labelling and Display) Regulations, 2020 and Food Safety and Standards (Packaging) Regulations, 2018.”
b. in sub-regulation 2.7.2, the provision starting with the words “Provided that if artificial sweetener………………. Food safety and Standards (Packaging and Labelling) Regulations, 2011” shall be substituted by the following, namely:-
“Provided that if sweetener has been added as provided in Appendix A, it shall be declared on the label as per schedule II of the Food Safety and Standards (Labelling and Display) Regulations, 2020 and Food Safety and Standards (Packaging) Regulations, 2018.”
c. in sub-regulation 2.7.3, the provision starting with the words “Provided further, if artificial sweetener ……… Food Safety and Standards (Packaging and Labelling) Regulations, 2011” shall be substituted by the following, namely: –
“Provided further that if sweetener has been added as provided in Appendix A, it shall be declared on the label as per schedule II of the Food Safety and Standards (Labelling and Display) Regulations, 2020 and Food Safety and Standards (Packaging) Regulations, 2018.”
d. in sub-regulation 2.7.4, under sub-clause (4) the provision starting with the words “Provided that it may contain artificial sweeteners …….. Food Safety and Standards (Packaging and Labelling) Regulations, 2011” shall be substituted by the following, namely: –
“Provided that it may contain sweeteners as provided in Appendix A, and shall have labelling declarations as per schedule II of the Food Safety and Standards (Labelling and Display) Regulations, 2020 and Food Safety and Standards (Packaging) Regulations, 2018.”
