Avimukt Dar And Ors Vs Bar Council of India And Anr (Delhi High Court)
The Delhi High Court issued notice in the case concerning a petition filed by Avimukt Dar and others against the Bar Council of India and another respondent. The petitioners are challenging the issuance of a Show Cause Notice (SCN) dated 5th August 2025, which required them to provide a detailed response regarding any partnership, collaboration, alliance, or business relationship between CMS and INDUSLAW. The SCN specifically demanded full disclosure of the operational nature of such relationships, copies of all agreements or related documents, declarations on whether legal services were rendered jointly or in a coordinated manner, and details of any shared infrastructure, branding, financial arrangements, personnel, referral systems, or client servicing models operated jointly.
The petitioners claimed that they had requested the material or documents forming the basis of the SCN, but the Bar Council did not provide them. Subsequently, a notice dated 4th November 2025 required the petitioners’ personal appearance on 16th November 2025. The petitioners argued that without access to the underlying material, their right to effectively respond to the SCN had been compromised and sought an interim direction for the Bar Council to provide the relevant documents before proceeding further.
