ORDER
New Delhi, the 23rd February, 2023

S.O. 882(E).In exercise of the powers conferred by section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016), and in supersession of the Bicycles- Retro Reflective Devices (Quality Control) Order, 2021, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 2028(E), dated the 25th May, 2021, except as respects things done or omitted to be done before such supersession, the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following Order, namely:-

1. Short title and commencement.(1) This Order may be called the Bicycles- Retro Reflective Devices (Quality Control) Order, 2023.

(2) It shall come into force from the 1st day of July, 2023.

2. Application.- This order shall apply to goods or articles specified in column (1) of the Table 1 and Table 2, but nothing herein shall apply to said goods or articles meant for export.

3. Conformity to standard and compulsory use of Standard Mark.- Goods or articles specified in column (1) of the Table 1 shall conform to the corresponding Indian Standard mentioned in column (2) of the said Table and shall bear the Standard Mark under a license from the Bureau as per Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.

4. Certificate of conformity.- Goods or articles specified in column (1) of the Table 2 shall conform to the corresponding essential requirement given in the column (2) of the said Table under a certificate of conformity from the Bureau as per Scheme-IV of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.

5. Certification and enforcement authority.- In respect of the goods or articles specified in column (1) of the Table 1 and Table 2, the Bureau shall be the certifying and enforcing authority.

6. Penalty for Contravention.- Any person who contravenes the provisions of this Order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016 (11 of 2016).

Note: For the purpose of Table 1, the latest version of the Indian Standards including the amendments thereof, as notified by the Bureau of Indian Standards from time to time, shall apply from such date as notified by said Bureau.
