Supreme Court directed constitution of ‘Committee for Service Conditions of the District Judiciary’ overseeing the implementation of the recommendations of the SNJPC as approved by this Court. Also, directed that applicability of TDS on allowance payable to judicial officer will be re-examined.
Facts- All the State governments and Union Territories have been given an opportunity to furnish their objections to the allowances, as proposed by the SNJPC. Objections have been filed on the record of this Court. Further, the issue also involved the question that whether the provisions for TDS will apply to allowances payable to the judicial officers under the Second National Judicial Pay Commission.
Conclusion- We direct the constitution of a Committee in each High Court for overseeing the implementation of the recommendations of the SNJPC as approved by this Court. The Committee shall be called the ‘Committee for Service Conditions of the District Judiciary’.
The issue is whether the provisions for TDS will apply to allowances payable to the judicial officers under the Second National Judicial Pay Commission. Mr N Venkataraman, Additional Solicitor General, has indicated that he would have the issue examined in the Revenue Department of the Ministry of Finance.
