NOTIFICATION

New Delhi, the 9th July, 2013

G.S.R. 469(E) – Whereas the draft Rules were published to amend the Ammonium Nitrate Rules, 2012, as required by sub-section (1) of section 18 of Explosive Act, 1884 (4 of 1884) vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) number G.S.R. 394 (E), dated the 21st day of June, 2013 in the Gazette of India, Part II, Section 3, Sub-Section (i) inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of a period of fifteen days from the date on which the copies of Gazette containing the said notification were made available to the public;

And, whereas, copies of the said Gazette were made available to the public on 21st day of June, 2013;

And whereas, objections and suggestions were received from the public on the said draft rules, have been duly considered by the Central Government;

Now therefore, in exercise of powers conferred by sections 5 and 7 of the Explosives Act, 1884 (4 of 1884), the Central Government hereby makes the following rules to amend the Ammonium Nitrate Rules, 2012, namely:-

1. (1) These rules may be called the Ammonium Nitrate (Amendment) Rules, 2013.

(2) They shall come into force on the date of their final publication in the Official Gazette

2. In the Ammonium Nitrate Rules, 2012-

(a) In the proviso of rule 5, for the words “period of one year” the words “period of eighteen months” shall be substituted;

(b) In rule 12, the following sub-rule shall be inserted, namely:-

“(9) The requirement of safety distances referred to in sub-rule(4) and clause (iii) of sub rule (8) shall not be applicable to those Ammonium Nitrate storage premises, which were existing on the date of publication of these rules and were within the approved premises of the licences granted under the Explosives Rules, 2008 and Gas Cylinders Rules, 2004 framed under the Explosives Act, 1884”.
