Export of cotton yarn by 100% EOUs in the cotton yarn sector is exempted from the restriction imposed on export of cotton yarn vide above notifications in terms of para 6.2(a) of Foreign Trade Policy, 2009-14 which stipulates that an EOU unit may export all kinds of goods and services except items that are prohibited in ITC (HS).
Trade & Industry is requested to see the details of the provision carefully in the aforesaid Notification and Public Notice on the subject. Any difficulty in implementation of the aforesaid guidelines shall be brought to the notice of this Directorate immediately.

Within eligible entitlement, an exporter may apply for one or more than one authorisation in a licensing year, subject to the condition that against one Port of registration, not more than five authorisations can be issued for same product group.
A new Appendix i.e., Appendix 23A related to “consumption and stocks of duty free material allowed under Advance authorization for Pharmaceutical product manufactured through NI process” along with the Central Excise certificate on consumption introduced, as appended to this Public Notice, as Annexure III.
Further, since this facility shall be available to manufacturer exporters only and not to the merchant exporters tied to supporting manufacturer, paragraph 4.1.3 of FTP has been amended as stated at Sl. No. 1 above.
The exporter would be entitled for import of alternate Import Item namely Antimony Triacetate indicated at S.No. 6 of the amended SION No. H-206. The above facility has been extended subject to conditions vide Note 1 and 2 above. Allowing of alternate raw material would facilitate exporters for the manufacture of Polyester (PET) Chips for wide ranging applications depending upon the export requirement.
Note 1 of Chapter 7 of ITC(HS) Classification of Export & Import Items (Chapter 7 deals with Edible Vegetables and Certain Roots and Tubers) stipulated that reference to onions in this chapter includes onions fresh or chilled, frozen, provisionally preserved or dried. This note has also been extracted in the Notification No. 13 of 22.12.2010. Therefore, the item description in the Notification No. 13 dated 22.12.2010 is clear leaving no room for ambiguity.
In exercise of the powers conferred by Section 5 of Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) read with Para 2.1 of the Foreign Trade Policy, 2009-2014, the Central Government hereby makes, with immediate effect, the following amendment to Notification No. 38 (RE-2007)/2004-2009, dated 15.10.2007 read with Notification No. 93 (RE-2007)/2004-2009 dated 1.4.2008, as amended from time to time.
