Ram Sagar Tiwari Vs Gulaab Singh Sonkar & Anr. (Supreme Court of India)

The Supreme Court of India addressed a contempt petition filed against a Uttar Pradesh Police officer, Gulaab Singh Sonkar (Respondent No. 1), alleging defiance of a protective court order. The petitioner, Ram Sagar Tiwari, contended that despite an interim order from the Supreme Court dated March 28, 2025, directing that no coercive measures be taken against him (subject to cooperation in the investigation), the first respondent, Gulaab Singh Sonkar, apprehended, dragged, and arrested the petitioner from his workplace on April 23, 2025, subjecting him to physical assault.

The petitioner alleged that when he presented the Supreme Court’s order to the Station House Officer (first respondent), the officer outrightly rejected it, used abusive language, and shouted in vernacular language, stating, “main kisi Supreme Court ka aadesh nahin manunga, mai tumhara sara High Court aur Supreme Court nikal dunga aaj.” (The petitioner noted that the full abusive language was not narrated in the petition for the sake of the court’s dignity). Following these grave allegations, the Supreme Court, in its order dated July 14, 2025, which disposed of a related Special Leave Petition (Crl.) No. 4755/2025, observed that the facts—supported by documentation—appeared to indicate a wilful disobedience of the interim protection.
