Avnish Jaiswal Vs Union of India (Jharkhand High Court)

The Jharkhand High Court addressed the bail application of Avnish Jaiswal, an accused in Complaint Case No. 3207 of 2025, concerning alleged offenses under various sections of the Central Goods and Service Tax (CGST) Act, 2017, and the Bharatiya Nyaya Sanhita (BNS), 2023. The petitioner was accused of being the “main master mind” behind a GST evasion scheme totaling ₹31.00 crores over different financial years.

The petitioner had remained in custody for almost three months when the court heard the matter. The prosecution report had already been submitted in the case. The maximum punishment prescribed for the alleged GST evasion is five years. Considering the period the petitioner had already spent in custody, the High Court decided to release the petitioner on bail. Avnish Jaiswal was directed to furnish a bail bond of ₹20,000/- with two sureties of the like amount to the satisfaction of the Special Judge, Economic Offences, Jamshedpur.

Heard the parties.

The petitioner has been made accused in connection with Complaint Case No. 3207 of 2025, for the offence registered under Sections 132(1)(b), 132(1)(c), 132(1)(f) and 132(1)(1) & 132(5) of the Central Goods and Service Tax Act, 2017 and Sections 61, 316 & 322 of the B.N.S., 2023, pending in the court of Sri Abhishek Prasad, learned Special Judge, Economic Offences, Jamshedpur.
