Subject:- Monthly Statement of Central Excise and Customs cases pending before Commissioner (Appeals) and CEGAT – Regarding.

The undersigned in directed to say that during the course of briefing regarding a Parliament Question, the Finance Minister expressed concern over mounting arrears of court cases and cases and cases pending before CEGAT and Commissioners (Appeals), and emphasised the need for proper co-ordination and monitoring of such cases.

2. It has been observed in this regard that Monthly Report in respect of cases pending before the Supreme Court and High Courts are being  received from all Commissioners and compiled in Board”s office. However, it appears that no such reports are prescribed as regards cases pending before CEGAT & Commissioners (Appeals).

3. Accordingly, Board has decided to prescribe Monthly Statements in respect of cases pending before CEGAT and Commissioner (Appeals). It is requested that the Statements in the formats enclosed** may be sent by name to Commissioner (Review) so as to reach Board”s office by the 20th of every month. The figures submitted may be tallied with the Monthly Tech. reports which are being separately submitted to the Board. Separate statements may be sent in respect of cases pending before Commissioner (Appeals) and before CEGAT. The statements for the month of July, 1995 may please be sent to the Board by the prescribed date.
