ORDER

Whereas, the Delhi Disaster Management Authority (DDMA) is satisfied that the NCT of Delhi is threatened with the spread of COVID-19 epidemic, which has already been declared as a pandemic by the World Health Organization, and has considered it necessary to take effective measures to prevent its spread in NCT of Delhi;

2. And whereas, considering the unprecedented surge in COVID-19 cases with high positivity rate and in order to break the transmission chain of COVID-19 virus, DDMA had imposed curfew on movement of individuals in the territory of NCT of Delhi with effect from 10:00 pm on 19.04.2021 (Monday) to 5:00 am on 26.04.2021 (Monday) vide Order No. 381 dated 19.04.2021, which was extended till 05:00 am on 03.05.2021 (Monday) vide Order No. 397 dated 25.04.2021, further extended till 05:00 am on 10.05.2021 (Monday) vide DDMA Order No. 407 dated 01.05.2021, further extended till 05:00 am on 17.05.2021 (Monday) vide DDMA Order No. 415 dated 09.05.2021, further extended till 05:00 am on 24.05.2021 (Monday) vide Order No. 423 dated 16.05.2021 and also extended till 05:00 am on 31.05.2021 (Monday) vide DDMA Order No. 426 dated 23.05.2021, as an emergency measure;

And whereas, the situation of COVID-19 in NCT of Delhi has again been reviewed and observed that, though the number of COVID-19 patients and positivity rate is declining, the situation is still precarious, therefore, in order to contain the spread of virus and to further break the transmission chain, curfew needs to be extended for another week in the territory of NCT of Delhi (except for essential activities / services), permitting reopening of certain prohibited activities in a phased manner in areas outside the containment zones for overall well being of the people of NCT of Delhi.

4. Now, therefore, in exercise of powers conferred under section 22 of the Disaster Management Act, 2005, the undersigned, in his capacity as Chairperson, State Executive Committee, DDMA, GNCTD, hereby directs to extend the curfew, on movement of individuals (except for essential activities/ services as already stipulated in DDMA Order No. 381 dated 19.04.2021, Order No. 397 dated 25.04.2021 and Order No. 415 dated 09.05.2021) in the territory of NCT of Delhi, till 05:00 am on 07.06.2021 (Monday) or further orders whichever is earlier.

5 (A) Furthermore, the following additional activities shall be allowed outside the Containment Zones during the curfew period:

i. Operations of Manufacturing / Production units within closed premises in Approved Industrial Areas.

ii. Construction activities within their work sites.

(B) The owners of manufacturing / production units, the owners / contractors / employers of construction activities shall be responsible for ensuring strict compliance of the following directives, in letter and spirit:

i. Only asymptomatic workers and employees will be allowed at workplace.

ii. Staggering of work / business hours will be followed at workplace in order to ensure proper social distancing between workers, adequate gaps between shifts, staggering the lunch breaks of staff etc.

iii. COVID Appropriate Behaviour shall be strictly followed by all workers/employees at workplace viz. wearing of face masks, maintaining social distancing, no spitting at public place, no consumption of Pan, Gutkha, Tobacco and Liquor at work place.

iv. Provision of thermal screening, hand wash and sanitizer preferably with touch free mechanism will be made at all entry and exist points and common areas.

v. Frequent sanitization of entire work place, common facilities and all points which come into human contact e.g. door handles etc. shall be ensured, including between shifts.

(C) The owners of manufacturing / production units, the owners / employers / contractors of construction activities will be responsible for strict compliance of aforesaid instructions / directives at work In case of any violation, concerned manufacturing / production unit of construction activity shall be closed, besides strict penal action would be taken against the violator(s) as well as the owner of manufacturing unit or owner/ employer/ contractor of construction work activity, as the case may be, under relevant Laws / Rules viz. Section 51 to 60 of Disaster Management Act, 2005, Section 188 of IPC and other applicable laws.

(D) The movement of workers/employees shall be allowed only on the possession of e-pass (in soft or hard copy), which can be obtained by the owners / employers / contractors by submitting online application with details of workers / employees on the website delhi.gov.in.

(E) All District Magistrates shall ensure random RT-PCR / RAT testing in sufficient numbers at these manufacturing / production units / construction sites on regular

(F) All District Magistrates and their counterpart district DCPs shall deploy Special Teams for regular inspection of these manufacturing / production units as well as construction sites for ensuring effective compliance of COVID Appropriate Behaviour by all workers / employees.

6. It is further reiterated that all District Magistrates, District DCPs, Deputy Commissioners of Municipal Corporations / Officers of NDMC and Delhi Cantonment Board, Vice Chairman, DAMB & Secretaries of APMCs and all other authorities concerned shall be responsible for ensurJng COVID Appropriate Behaviour wearing of mask, maintaining social distancing etc. in all Mandis, ISBTs, Railway platforms / Stations, Slum areas as well as at all shops which are providing essential goods & services during curfew such as grocery shops, medicine shops, fruit & vegetable shops, road side vendors etc. It should be ensured that the people who visit these places strictly follow COVID Appropriate Behaviour and are wearing masks, maintaining social distancing etc. without fail. It should also be ensured that no shops (of non essential commodities or services) or weekly markets are functioning illegally within the jurisdiction of respective District Magistrates. The Market Trade Associations (MTAs) and Resident Welfare Associations (RWAs) shall also be responsible for ensuring compliance of COVID Appropriate Behaviour by all shopkeepers and residents within the premises of markets and societies. All authorities concerned shall take strict action against the defaulting persons, shopkeepers, weekly marketers as per the applicable laws and rules, including closure of such shops / business premises.

7. Further, Police authorities shall ensure effective checking of movement of persons and vehicles by putting adequate number of checking points / pickets with the objective to prevent unnecessary movement of people on roads during curfew. Delhi Police shall also ensure that movement of individuals and vehicles should be allowed strictly as per the guidelines / protocols prescribed in the curfew order.

8. Commissioner, Delhi Police, Pr. Secretary (Revenue), Pr. Secretary (H&FW), GNCTD, all District Magistrates of Delhi & their counterpart District Deputy Commissioners of Police and all other authorities concerned are directed to ensure strict compliance of this order and to take all requisite actions for effective implementation of the extant directions of MHA, of India issued vide order dated 29.04.2021 and extended till 30.06.2021 vide MHA order dated 27.05.2021 (copy enclosed) regarding Containment, Testing and Surveillance, Clinical Management, Vaccination, Community Engagement, COVID Appropriate Behaviour etc. The authorities concerned shall adequately inform and sensitize the field functionaries about these instructions for strict compliance, in letter and spirit.

9. In case any person is found violating the aforesaid instructions, the defaulting person(s) shall be proceeded against as per the provisions of section 51 to 60 of the Disaster Management Act, 2005, Section 188 of IPC and other applicable laws.

10. E-pass possessed by a person for movement connected to essential goods and services during night / weekend curfew / aforesaid curfew periods Shall remain valid during the curfew period.

ORDER

Whereas, an Order cl’ even number dated 23.03.2021 was issued for effective control of COVID-19 in the country, for a period upto 30.04.2021;

And whereas, considering the unprecedented surge in COVID-19 cases across the country, Ministry of Health & Family Welfare (MoHFW) vide DO No. Z.28015/85/2021-DM Cell dated 25th April 2021, has issued an advisory to all States and Union Territories (UTs), for implementing intensive, local and focused containment framework, in specific districts/cities/areas, identified based on a prescribed criterion;

Whereas. in exercise of the powers under section 6(2)(i) of the Disaster Management Act, 2005. National Disaster Management Authority (NDMA) has directed the undersigned to issue an order. for ensuring compliance on the focused containment measures, as mentioned in the aforesaid MoHFW letter dated 25.04.2021, for containment or COVID-19 in the country;

Now therefore, in exercise of the powers, conferred under Section 10(2)(I) of the Disaster Management Act 2005, the undersigned, hereby directs the State/ Union Territory Governments and State/ Union Territory Authoritics to consider the containment measures for COVID-19, as conveyed vide aforesaid Mol-IFW advisory dated 25.04.2021, as per Annexure-I, for immediate implementation in their State/UT, based on the assessment of the situation, until 31.05.2021. States/UTs, will take the necessary containment measures, under the relevant provisions of the Disaster Management Act 2005. It is further directed that:

(i) The National Directives for COVID-19 Management, as specified in Annexure-II, shall continue to be strictly followed throughout the country.

(ii) All the District Magistrates shall strictly enforce the containment measures taken by States/UTs and the National Directives.

(iii) any person violating these measures will be liable to be proceeded against as per the provisions of Section 51 to 60 of the Disaster Management Act 2005, besides legal action under Section 188 of the IPC, and other legal provisions as applicable.
