Due to the COVID-19 pandemic many government departments have provided multiple relaxation in dates of filing documents or information in order to provide ease to the business operator who are facing difficulty in this lockdown situation. The Ministry of Corporate Affairs also watching difficulty of the business have provided relaxation in the Name Reservation service on 22nd days of April, 2020.
As per the guidelines issued by the MCA Extension has been provided for name reserved and resubmission of the same. The extension are as follows:
IN CASE OF COMPANIES
1. If any person has already filed the Part A of Spice+ pursuant to which the name is approved and reserved for 20 days. Then if those 20 days ends between 15th March, 2020 to 3rd May, 2020 then the name will not be lapsed due to non-filing of Part B of Spice+. Extra 20 days beyond 3rd May will be granted i.e. till 23rd May, 2020 for filing of PartB of Spice+.
2. If any person has already filed the RUN (Reserve Unique Name) for name change pursuant to which the name is approved and reserved for 60 days. Then if those 60 days ends between 15th March, 2020 to 3rd May, 2020 then the name will not be lapsed due to non-filing of INC-24. Extra 20 days beyond 3rd May will be granted i.e. till 23rd May, 2020 for filing of INC-24 for name change
3. If SRN’s are sent for resubmission and the date for resubmission of SRN fall between 15th March, 2020 to 3rd May, 2020 then Additional 15 days beyond 3rd May will be granted. That means 18th May,2020 will be the last date for resubmission. However, for SRNs already marked under NTBR(Not to be taken on Record), extension would be provided on case to case basis.
IN CASE OF LLP
1. If any person has already filed the RUN-LLP pursuant to which the name is approved and reserved for 90 days. Then if those 90 days ends between 15th March, 2020 to 3rd May, 2020 then the name will not be lapsed due to non-filing of FiLLiP. Extra 20 days beyond 3rd May will be granted i.e. till 23rd May, 2020 for filing of FiLLiP.
2. If any person has already filed the RUN-LLP for name change pursuant to which the name is approved and reserved for 90 days. Then if those 90 days end between 15th March, 2020 to 3rd May, 2020 then the name will not be lapsed due to non-filing of Form-5. Extra 20 days beyond 3rd May will be granted i.e. till 23rd May, 2020 for filing of Form-5 for name change.
3. If SRN’s are sent for resubmission and the date for resubmission of SRN fall between 15th March, 2020 to 3rd May, 2020 then Additional 15 days beyond 3rd May will be granted. That means 18th May,2020 will be the last date for resubmission. However, for SRNs already marked under NTBR(Not to be taken on Record), extension would be provided on case to case basis.
Therefore, we can say that due to these relaxations many people who were facing problem for arranging the documents for filing the aforesaid form will be benefited.
