Two-wheeler makers will now have to sell a helmet along with their bikes and scooters after the Supreme Court today dismissed a plea by the Society of Indian Automobile Manufacturers against such a step. A bench comprising Justice G S Singhvi and Justice A K Ganguly dismissed the petition filed by the Society of Indian Automobile Manufacturers (SIAM) challenging an earlier order of the Delhi High Court.

The apex court said the manufacturers would have to give BSI certified helmets as “original equipment”.

On July 30, 2009, the High Court made it mandatory for dealers to sell helmets along with new two-wheelers and said that the vehicle would not be registered by the authorities without it.

SIAM contended that the High Court order would restrict the people’s choice to buy their own helmet.

    If I have a bike with halmet if I buy another bike then I purchase new halmet from the bike saler or not .clear supreme court judgement.

    A good decision. This is akin to safety belt in the car. It is a welcome move. The two wheelers have to be supplied with the helmet as a compulsary accessory.

    Its ridiculous, first of all, there is no point in buying a helmet if the customer already have one. Second is the customer will not be having the option to choose the right helmet.

    There is less concern in use of cell phones while driving either 2 wheeler or 4 wheeler. Though here and there Police are taking action, it is not proportionate to the cause. Ban in use of cellphone is absolute necessity. The ban should be that of canceling the license issued for driving and also levying very heavy penalties may to some extent may reduce the risks.

    With so much concern on public safety, in the same spirit, let them issue ruling to BAN use of cellphones while driving. The most riskiest & costly act is to attend to cell phones while driving – either 2 or 4 wheeler. it would be wise to ban & spot fine a substantial amount for using cell phones while driving.
    CELL PHONES, WHILE DRIVING SHOULD BE BANNED / SPOT FINED.

    If somebody already have Two-wheeler and buy another one than there is no necessary to mandate such things on two wheeler makers.
