The Insolvency and Bankruptcy Board of India’s First Appellate Authority, by order dated 13th August 2026 under Section 19 of the Right to Information Act, 2005, disposed of RTI Appeal Nos. ISBBI/A/E/26/00028, ISBBI/A/E/26/00034 and ISBBI/A/E/26/00035 concerning information sought regarding valuation conducted during the insolvency resolution process of Tuljabhavani Cold Storage Pvt Ltd. The Appellant sought records relating to an IBBI complaint against registered valuers, proceedings on the complaint, valuers’ replies and supporting valuation documents, including government rates and valuation bases for land, RCC buildings and ancillary structures. The First Appellate Authority noted that the RTI applications were filed on 23rd June, 1st July and 2nd July 2026, with corresponding statutory deadlines under Section 7 expiring on 23rd July, 1st August and 2nd August 2026, while the CPIO furnished replies on 7th August 2026, beyond the prescribed timeline. The Authority urged the CPIO to comply with RTI timelines in future but found that, since replies had been furnished, the appeals did not merit interference and accordingly disposed of the appeals.

The Appellant has filed the present Appeals dated 23rd July 2026, 1st August 2026 and 3rd August 2026 challenging the communication of the Respondent, filed under the Right to Information Act (RTI Act). Since the Appeals pertain to valuation conducted during the insolvency resolution process of Tuljabhavani Cold Storage Pvt Ltd, same are disposed of vide impugned common order.
2. Broadly, the Appellant has sought the following details in the impugned RTI applications: –
i. Copy IBBI finding on receipt of the communication of complaint from Dhananjay Gaekwad against IBBI Reg Valuator who done valuation of Tuljabhavani Cold Storage Pvt Ltd in CIRP Process.
ii. Copy of the entire papers of proceedings on record with IBBI regarding complaint filed by Dhananjay Gaekwad against IBBI Reg Valuator who done valuation of Tuljabhavani Cold Storage Pvt Ltd in CIRP Process.
iii. Reply filed by Valuators on receipt of Complaint processed by IBBI IIP, supportive documents Submitted by Valuators in support of value taken to do valuation of Tuljabhavani Cold Storage Pvt Ltd land and RCC Building.
iv. Supportive documents submitted (Government rate for MIDC Land, Government rate for heavy structure RCC Building of Tuljabhavani Cold Storage Pvt Ltd) by Valuators from which value taken by Valuators to do valuation of Tuljabhavani Cold Storage Pvt Ltd land and RCC Building.
v. Copy of papers with ICSI IIP as they ask for any documents from Complainant with regarding Complaint filed against Valuators.
vi. Documents submitted by valuers in support of their valuation of Tuljabhavani Cold Storage Pvt Ltd such as (i) the Government Ready Reckoner Rate applicable to the land situated in the Baramati MIDC Industrial Area. (ii) the Government-prescribed rate for a heavy three-storeyed industrial RCC building located in the Pune Urban Area, as specified in the Government Ready Reckoner Schedule, which was reliedupon for the valuation of the RCC building of Tuljabhavani Cold Storage Pvt. Ltd. (iii) The valuation basis and applicable rates for ancillary structures and improvements, including the compound wall, temporary shed, security cabin, concrete work executed on the plot, and other appurtenant assets.
1. The Appellant has filed the instant Appeal stating that the CPIO has failed to furnish the information sought by the Appellant.
2. I have carefully examined the application, the response of the Respondent and the instant Appeal and find that the matter can be decided based on the material available on record. In terms of section 2(f) of the RTI Act ‘information’ means records, documents, memos e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force.” It is pertinent to mention here that the Appellant’s “right to information’ flows from section 3 of the RTI Act and the said right is subject to the provisions of the Act. Section 2(j) of the RTI Act defines the which is held by or is under the control of a public authority. Thus, if the public authority holds any information in the form of data, statistics, abstracts, etc. an applicant can have access to the same under the RTI Act subject to exemptions under section 8.
3. In this regard, I note that the Appellant had filed the RTI applications on 23rd June 2026, 1st July 2026 and 2 nd July 2026. The deadline to dispose of the impugned RTI Application expired on 23rd July 2026, 1st August 2026 and 2 nd August 2026. However, the CPIO has furnished the replies to the impugned application on 7th August 2026, which is beyond the timeline enshrined under Section 7 of the RTI Act. Being CPIO of a Public Authority like IBBI, the Respondent should be sensitive to timelines and disposal of information request. I would, therefore, encourage and urge the Respondent to consider the requirements of law while dealing with information requests under the RTI Act and dispose of RTI applications within the prescribed time in future. Since the CPIO has furnished the replies, the Appeals does not merit any interference at this stage.
4. The Appeal is, accordingly, disposed of.
