Sahil Goyal Vs State of Punjab (Punjab and Haryana High Court)
The Punjab and Haryana High Court granted regular bail to the petitioner in a ₹48.6 lakh GST-related cement supply fraud case. The case arose from FIR No. 127 dated 10 June 2025, registered under Sections 318(4), 336(2), 340(2), and 336 of the Bharatiya Nagarik Suraksha Sanhita, 2023, at Police Station City Sunam, District Sangrur. The FIR was based on a complaint alleging that in December 2024, the petitioner and co-accused offered to supply cement at the cement project rate. The complainant made payments via cheques totaling ₹48,60,500/- to Goyal Traders for 16,270 bags of ACC cement. However, the petitioner supplied only 700 bags and issued fabricated bills in the name of Agarwal & Company, which shared the same GST number as Goyal Traders, thereby allegedly defrauding the complainant.
The petitioner was arrested on 16 July 2025, and investigation has since been completed. Counsel for the petitioner argued that he was falsely implicated, has clean antecedents, and that the dispute is civil in nature. He contended that further incarceration would serve no purpose, as the case is documentary and the trial would be lengthy. The State opposed bail, citing the seriousness of the allegations.
