These rules may be called the draft Patents (Amendment) Rules, 2021. (2) They shall come into force on the date of their publication in the Official Gazette.
In case an application processed by a natural person or startup or small entity is fully or partly transferred to a person other than a natural person, startup or small entity, the difference, if any, in the scale of fees between the fees charged from the natural person, startup or small entity and the fees chargeable from the person other than a natural person, startup or small entity in the same matter, shall be paid by the new applicant with the request for transfer.
Patents (Amendment) Rules, 2020- streamlining of the requirements related to filing of Form 27 and submission of verified English translation of priority documents. Patentee would get flexibility to file a single Form-27 in respect of a single or multiple related patents. This will ease compliance burden & boost innovation
Grant of a patent implies a statutorily granted monopoly on the use of invention. Setting aside the concern that this invention should not be exploited at the cost of public interest.
