Ramesh Kumar Totla Vs Shyam Sundar Commodities Pvt. Ltd (NCLAT Delhi)
The National Company Law Appellate Tribunal (NCLAT), Delhi, has declined to intervene in an appeal filed by Ramesh Kumar Totla, the Liquidator, concerning ongoing applications related to an auction dispute. The appeal challenged an order dated June 11, 2025, from the National Company Law Tribunal (NCLT), Ahmedabad, which directed parties to file short written submissions for pending Interlocutory Applications (IAs) IA No. 410 of 2024 and IA No. 1528 of 2024. These IAs were filed by a successful auction purchaser.
The NCLAT noted that it had previously, on October 21, 2024, in Company Appeal (AT) (Insolvency) No. 1961 of 2024, instructed the NCLT to consider and decide these applications expeditiously, directing the Liquidator to pause the auction process until their disposal. The Liquidator’s current appeal highlighted delays, with the NCLT repeatedly calling for written submissions. While the NCLAT saw no immediate reason to entertain the current appeal, it urged the NCLT to dispose of the applications on the next scheduled date, July 28, 2025, or as soon as possible, to enable the liquidation process to proceed.
