Service tax is the tax imposed by the government on the service providers on certain transactions and it is borne by the consumers. It was introduced in the Finance Act of 1994, it is an indirect tax levied on the services. Any service provider or organization that provides the taxable service over nine lakh must register the service tax because it helps the Department of Service tax to identify assesses and keep on track of all the aspects of compliances.
Appellant is the centrally registered taxpayer and the error committed could not be detected immediately and it took almost a month to recognise the excess payment made in the month of May, 2011 and hence it was adjusted against the tax liabilities for the month of July, 2011

Recently, in a case of an assessee whose bank accounts were ordered to he attached without giving any opportunity to them, the Hon’ble Allahabad High Court after a detailed analysis of the legal provisions, observed, inter- alia, that the order directing attachment of the property without waiting for a reply to the show cause notice, and without giving any opportunity and without giving any notice, was in gross violation of Rule 3 of the Rules of 2008 read with paragraph 2 (iii) of the Circular dated 1st July, 2008.
Rule 6(2) of the Service Tax Rules, 1994 stipulate that while every assessee shall pay service tax electronically through internet banking, the jurisdictional Deputy/Assistant Commissioner, may, for reasons to be recorded in writing, allow the assessee to deposit service tax by any other mode.
