Jakir Husain @ Jakir Hussain Vs Commissioner of Customs & Ors. (Delhi High Court)

The Delhi High Court, in the case of Jakir Husain @ Jakir Hussain vs. Commissioner of Customs, addressed a writ petition concerning the release of two gold bars seized by the Customs Department. The petitioner, Jakir Husain, sought the release of the gold, collectively weighing 233 grams, which was detained at the Indira Gandhi International Airport on December 24, 2023.

Husain’s petition, filed under Articles 226 and 227 of the Constitution of India, contended that despite applications for release on May 27, 2024, and July 17, 2025, no Show Cause Notice had been issued. He argued that the gold bars should therefore be released. The petitioner’s application from July 2025 had authorized an advocate, Mr. Aman Kumar Yadav, to act on his behalf, though this authority was later alleged to have been withdrawn.

During the hearing, the Delhi High Court found that the facts presented in the petition concealed a key development. The Senior Standing Counsel (SSC) for the Customs Department, Mr. Aditya Singla, informed the court that the gold bars had, in fact, been released to the petitioner’s authorized representative, Mr. Aman Kumar Yadav, on July 24, 2025, after payment of approximately Rs. 7,00,000.
