XYZ (Confidential) Vs Navodaya Vidyalaya Samiti (Competition Commission of India)

Competition Commission of India (CCI) has dismissed allegations of anti-competitive conduct brought by XYZ against Navodaya Vidyalaya Samiti (NVS) and RailTel Corporation of India Ltd. The informant alleged that NVS and RailTel violated Sections 3 and 4 of the Competition Act, 2002, in relation to a tender for the implementation of integrated infrastructure and IT solutions under the Prime Minister Schools for Rising India (PM SHRI) scheme.

The informant claimed that NVS, an autonomous body under the Ministry of Education, unfairly awarded a work order worth Rs. 162.73 crores to RailTel, a public sector undertaking, without a transparent selection process. It was argued that RailTel, primarily involved in telecom infrastructure, lacked prior expertise in the PM SHRI scheme. Subsequently, RailTel issued a Request for Proposal (RFP) with stringent and arbitrary technical specifications that effectively excluded numerous potential bidders, indicating a tacit agreement between NVS and RailTel.

The informant further alleged that NVS abused its dominant position by appointing RailTel as the Project Management Consultant (PMC) without providing reasonable justifications. RailTel was also accused of abusing its dominance by issuing a faulty RFP that clubbed diverse products, provided vague specifications, and introduced biased prequalification criteria. The informant cited several issues, including the exclusion of MSEs, the lack of a pre-bid meeting, and the categorization of the RFP under an incorrect service category, as evidence of anti-competitive behavior.
