CCI Dismisses Complaint Against Victor Hospital Over Alleged Anti-Competitive Practices: The Competition Commission of India (CCI) has dismissed a complaint filed by Moses Pinto against Victor Hospital, alleging anti-competitive conduct under Sections 3 and 4 of the Competition Act, 2002. The complaint stemmed from a medical negligence claim involving a laparoscopic appendectomy performed by Dr. P. Ravi Teja at Victor Hospital. Pinto alleged that the hospital misrepresented the surgeon’s qualifications, misleading consumers and gaining an unfair market advantage over compliant healthcare providers. The Commission, however, ruled that the allegations did not raise any competition concerns under the Act and closed the matter under Section 26(2).
The Informant detailed that after undergoing surgery at Victor Hospital, he suffered complications requiring further medical intervention. A subsequent procedure at BLK-MAX Hospital in New Delhi revealed that part of the appendix and a fecalith had been left behind, necessitating further resection. Pinto also claimed that Dr. Ravi Teja lacked valid registration with the Goa Medical Council at the time of the surgery, in contravention of the National Medical Commission Act, 2019. Despite this, Victor Hospital allegedly continued to promote him as a qualified consultant surgeon, misleading patients and distorting consumer choice.
