The Ministry of Consumer Affairs, Food & Public Distribution, Government of India, has initiated a public consultation regarding proposed amendments to Rule 3 of the Legal Metrology (Packaged Commodities) Rules, 2011.

Rule 3 of the Legal Metrology (Packaged Commodities) Rules, 2011 currently exempts certain categories of packaged commodities from its applicability, such as packages exceeding 25 kilograms or liters, certain specified commodities like cement and fertilizer sold in bags over 50 kilograms, and those meant for industrial or institutional consumers. The proposed amendment seeks to refine this exemption list to bring clarity, particularly regarding agricultural farm produce.

The ambiguity arises from the lack of a clear definition of “agricultural farm produce” within the current rules. Stakeholders have highlighted the need for clarity, especially as these rules apply to all packaged commodities intended for retail sale.

The suggested revision aims to redefine the scope of Rule 3 to specify that it applies universally to all packaged commodities sold in retail-sized bags, except those explicitly designated for industrial or institutional use.

Subject: Request to amend Rule 3 of the Legal Metrology (Packaged Commodities) Rules, 2011 for clarity – reg.

Sir/ Ma’am,

The undersigned is to refer to the above-mentioned subject and to state that a representation is received requesting to amend Rule 3 of the Legal Metrology (Packaged Commodities) Rules, 2011 to bring clarity about the applicability of rules.

2. It is to state that rule 3 provides applicability of rules as follows:

“3. Application of Chapter. – The provisions of this chapter shall not apply to-

(a) packages of commodities containing quantity of more than 25 kilogram or 25 litre;

(b) cement, fertilizer and agricultural farm produce sold in bags above 50 kilogram; and

(c) packaged commodities meant for industrial consumers or institutional consumers.”.

3. However, the agriculture farm produce are not defined under the rules, and rules are applicable for all packaged commodities meant for retail sale. Therefore, it is proposed to amend Rule 3 of the said Rules.

4. Therefore, it is requested to offer your comments on the following proposal within 15 days that:
