Held that an arbitral award awarded without any basis and also without adjudication of the claims is unsustainable in law.

Facts-

The present petition is filed by KBUNL (petitioner) u/s. 34 of the A&C Act impugning an arbitral award delivered by an Arbitral Tribunal comprising of sole arbitrator.

The background of the matter is that as per the Supply and Service Contract (Contracts) dated 10.09.2011, the respondent (PCTEL) agreed to supply its service for “induced draft cooling tower package for Muzaffarpur Thermal Power Project Stage-II”. The work under the contracts commenced from 09.08.2011 and was to be completed within a period of 24 months i.e., by 08.08.2013.
