Central Universities (Amendment) Bill, 2021 is introduced in lok Sabha on 05/08/2021. The Central Universities (Amendment) Bill, 2021 seeks to amend the Central Universities Act, 2009 inter alia to provide for the establishment of a University in the name of ‘Sindhu Central University’ in the Union territory of Ladakh.

further to amend the Central Universities Act, 2009.

BE it enacted by Parliament in the Seventy-second Year of the Republic of India as follows:—

1. Short title and commencement.

(1) This Act may be called the Central Universities (Amendment) Act, 2021.

(2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint.

2. Amendment of section 3A.

In the Central Universities Act, 2009 (hereinafter referred to as the principal Act), in section 3A, for the words “State of Jammu and Kashmir”, wherever they occur, the words “Union territory of Jammu and Kashmir” shall be substituted.

3. Insertion of new section 3E.

In the principal Act, after section 3D, the following section shall be inserted, namely:—

Establishment of Sindhu Central University.

“3E. There shall be established a University, which shall be a body corporate, to be known as the Sindhu Central University, having its territorial jurisdiction extending to the whole of the Union territory of Ladakh, as specified in the First Schedule to this Act.”.

4. Amendment of First Schedule.

In the First Schedule to the principal Act,—

(i) for serial numbers 8 and 9 and the entries relating thereto, the following serial numbers and entries shall be substituted, namely:—

“8. Jammu and Kashmir Central University of Kashmir Kashmir Division of the Union territory of Jammu and Kashmir.
9. Jammu and Kashmir Central University of Jammu Jammu Division of the Union territory of Jammu and Kashmir.”;

(ii) after serial number 12 and the entries relating thereto, the following serial number and entries shall be inserted, namely:—

“12A Ladakh Sindhu Central University Whole of the Union territory of Ladakh.”

STATEMENT OF OBJECTS AND REASONS

The Central Universities Act, 2009 was enacted to establish and incorporate universities for teaching and research in various States and for matters connected therewith or incidental thereto.

2. At present, there is no Central University in the Union territory of Ladakh. Therefore, the Government has decided to establish a new Central University in the Union territory of Ladakh to ensure increase in accessibility and quality of higher education and to facilitate and promote avenues of higher education and research for the people of the Union territory of Ladakh. This shall also cater to the regional aspirations for years to come.

3. The Central Universities (Amendment) Bill, 2021 seeks to amend the Central Universities Act, 2009 inter alia to provide for the establishment of a University in the name of “Sindhu Central University” in the Union territory of Ladakh.

4. The Bill seeks to achieve the above objects.

THE CONSTITUTION OF INDIA

The President, having been informed of the subject matter of the Central Universities (Amendment) Bill, 2021, recommends consideration of the Bill in Lok Sabha under clause (3) of article 117 of the Constitution of India.

FINANCIAL MEMORANDUM

Clause 2 of the Bill seeks to insert a new section 3E in the Central Universities Act, 2009 which provides for the establishment of a new University, to be known as the Sindhu Central University, as a body corporate having territorial jurisdiction extending to the whole of the Union territory of Ladakh.

2. The infrastructure for the University will be set up with a budgetary provision of rupees 750 crores for seven years in two phases. The expenditure in the first phase of four years shall approximately be rupees 400 crores and in the second phase of remaining three years shall approximately be rupees 350 crores. The said expenditure shall be met from the Consolidated Fund of India through the budgetary provisions of the Ministry of Education.

Special provision with respect to the State of Jammu and Kashmir.

3A. (1) The Central University of Jammu and Kashmir established under sub-section (4) of section 3 shall be known as the Central University of Kashmir and its territorial jurisdiction shall be limited to the Kashmir Division of the State of Jammu and Kashmir.

(2) There shall be established a university, which shall be a body corporate, to be known as the Central University of Jammu having its territorial jurisdiction extending to the Jammu Division of the State of Jammu and Kashmir.

(3) All assets and liabilities of the Central University of Jammu and Kashmir in respect of the territory of Jammu Division of the State of Jammu and Kashmir shall stand transferred to be the assets and liabilities of the Central University of Jammu.

(4) Anything done or any action taken by the University of Jammu and Kashmir in respect of the territory of Jammu Division of the State of Jammu and Kashmir shall be deemed to have been done or taken by the Central University of Jammu.

(5) Any suit or legal proceedings instituted or continued by or against the Central University of Jammu and Kashmir in respect of the territory of Jammu Division of the State of Jammu and Kashmir shall be deemed to have been instituted or continued by or against the Central University of Jammu.
