NOTIFICATION NO. 89 (RE-2007)/2004-2009

Subject: Prohibition on export of Basmati and non-basmati rice-regarding.
S.O. (E) In exercise of the powers conferred by Section 5 read with Section 3(2) of the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government hereby makes the following amendments to Notification No.38(RE-2007)/2004-2009, dated 15.10.2007 as amended from time to time :
1. The entry at S.No.45AA in Chapter 10 under Schedule 2 of ITC(HS) Classification of Export and Import Items stands substituted as under: –

2. First sentence of Paragraph 2.3 will be substituted as follows : –
“The prohibition imposed by this Notification shall not be applicable to the export of non-basmati rice if the Minimum FOB Export Price (MEP) is US$ 1000 per ton or Rs.40,000/- per ton.”

4. Transitional arrangements allowed under Para 1.5 of the Foreign Trade Policy, 2004-2009, shall, in public interest, not be applicable to the ban imposed above. However, Para 9.12 of Handbook of Procedures, Vol-I, 2004-2009, shall be applicable.
