Notification No. 39/2006-Customs

Whereas, the designated authority vide notification No. 15/29/2004-DGAD, published in Part I, Section I of the Gazette of India, Extraordinary, dated the 2nd May, 2005, has initiated sunset review in the matter of continuation of anti-dumping duty on Sodium Hydroxide, commonly known as Caustic Soda (herein after referred to as subject goods) falling under Chapter 28 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), originating in or exported from Iran, Saudi Arabia, United States of America, France and Japan, imposed vide notification No.69/2001- Customs, dated the 26th June, 2001, G.S.R.461(E), dated the 26th June, 2001 and had requested for suitable extension of anti-dumping duty, pending the results of the review investigations;

And whereas on the basis of the aforesaid request of the designated authority, the Central Government had extended the levy of an anti-dumping duty on the subject goods vide notification of the Government of India in the erstwhile Ministry of Finance (Department of Revenue), No. 98/2005-CUSTOMS, dated 25th November, 2005, G.S.R 689(E), dated the 25th November, 2005;

And whereas the designated authority has requested for extending the levy of anti-dumping duty for further period of three months pending the results of the review investigations, which has also been  extended up to 1st August, 2006;

Now, therefore, in exercise of the powers conferred by sub-section (1), the second proviso to sub-section (5) and sub-section (6) of section 9A, of the said Customs Tariff Act read with rule 23 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, the Central Government hereby makes the following further amendment in the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 69/2001- CUSTOMS, dated the 26th June, 2001, G.S.R.461(E), dated the 26th June, 2001, namely:-

In the said notification, in Paragraph 2, for the figures and words “25th day of June, 2006” the figures and words “25th day of September, 2006” shall be substituted.

NOTE: –   The principal notification No. 69/2001- CUSTOMS dated the 26th June, 2001 was published vide  number GSR 461(E) dated the 26th June 2001 and was subsequently amended by notification No. 98/2005-Customs, dated 25th November, 2005, GSR 689 (E) dated the 25th November, 2005.
