S. Madhusudhan Reddy Vs V. Narayana Reddy And Others (Supreme Court of India)

The Supreme Court of India examined appeals against a judgment of the Telangana High Court that had allowed a second set of review petitions and set aside an earlier judgment dated 9 July 2013, which had upheld an appellate authority’s decision restoring tenancy records in favour of the predecessors of the appellant. The dispute related to alleged surrender of protected tenancy rights in 1967, accepted by the Tehsildar, leading to deletion of the tenants’ names from revenue records. The appellant’s predecessors challenged this surrender decades later, leading to prolonged litigation before revenue authorities and the High Court.

The High Court initially upheld the appellate authority’s decision rejecting the alleged surrender and restoring tenancy entries. Review petitions filed by the respondents were dismissed in 2014. Subsequently, the respondents approached the Supreme Court, which permitted them to file a review if they could obtain documents evidencing surrender. Relying on this liberty, the respondents filed a second set of review petitions before the High Court, producing certified copies of revenue records. The High Court allowed these petitions and upheld the 1967 surrender proceedings.

The Supreme Court considered whether such successive review petitions were maintainable under Section 114 and Order XLVII Rule 1 of the Code of Civil Procedure. It reiterated that review jurisdiction is limited to discovery of new and important evidence not previously available despite due diligence, error apparent on the face of the record, or similar sufficient reasons. It emphasized that review cannot be used to reargue the case or substitute an earlier view.
