S. Murali Sundaram Vs Jothibai Kannan & Ors. (Supreme Court of India)

The Supreme Court of India considered appeals challenging a judgment of the Madras High Court (Madurai Bench), which had allowed a review application and set aside its earlier decision in a writ petition concerning a dispute over a pathway. The original writ petition was filed against an order of the Tiruchirappalli City Municipal Corporation. In its judgment dated 03.03.2017, the High Court had allowed the writ petition after rejecting a survey report relied upon by the respondents and instead relying on other reports.

Subsequently, the respondents filed a review application under Order 47 Rule 1 of the Code of Civil Procedure, 1908. The High Court allowed the review application, holding that its earlier judgment was erroneous, and set aside the original writ decision. Consequentially, related writ petitions and a contempt petition were also dismissed. This led to the present appeals before the Supreme Court.

The primary issue before the Court was whether the High Court was justified in exercising its review jurisdiction to set aside its earlier judgment. The Supreme Court examined the scope of review under Section 114 read with Order 47 Rule 1 CPC. It reiterated that review proceedings are limited and cannot be treated as an appeal. A review is permissible only in cases of an error apparent on the face of the record, discovery of new evidence, or similar sufficient reasons. It emphasized that an error must be self-evident and not one requiring detailed reasoning. An erroneous decision on merits cannot be corrected through review.
