The petitioner approached the Telangana High Court challenging a seizure memo dated 10 November 2025, issued by the fifth respondent, concerning the imported consignment of 233 multifunctional devices under Bill of Entry No. 5212205 dated 20 October 2025. The petitioner requested the immediate provisional release of the seized goods.
The Court observed that similar writ petitions of identical nature had previously been considered by the Bench. In those cases, the High Court had granted conditional interim release of seized goods provided the petitioners complied with certain conditions. One such case, W.P. No. 12489 of 2025, involved imported goods seized by Customs authorities. By way of an interim order, the High Court directed the authorities to release the goods on conditions including payment of the enhanced duty amount, deposit of a bank guarantee equivalent to 10% of the total value of the imported goods, and maintenance of detailed records of sales transactions following provisional release. The order also clarified that the conditional release would not hinder further proceedings or adjudication by the Customs Department. Any application for waiver of demurrage charges was to be considered objectively.
The interim order in W.P. No. 12489 of 2025 was challenged before the Supreme Court in SLP No. 42808/24, but the Supreme Court refused to interfere with the High Court’s order, while permitting the adjudicating authority to continue proceedings in accordance with law. The petitioner was entitled to participate in these proceedings. Following this, the High Court disposed of all pending writ petitions where seized goods had been released, ensuring that the ongoing adjudication was not affected.
