Dineshwar Saw Vs State of Jharkhand (Jharkhand High Court)
The Jharkhand High Court heard the anticipatory bail plea of petitioner Dineshwar Saw, who apprehended arrest in connection with Telaiya P.S. Case No. 240 of 2025, registered under Sections 303(2), 317(2), and 317(5) of the Bharatiya Nyaya Sanhita (BNS), 2023, pending before the A.C.J.M., Koderma. The petitioner, a scrap dealer and proprietor of M/s Dineshwar Saw, claimed ownership of the seized iron scrap, which was sold to M/s Tushyam Mattel Pvt. Ltd., Gajhandi Road, Gumo. He asserted that the seized material was not stolen property and emphasized that he holds a valid GST registration and has no prior criminal record, as mentioned in paragraph 10 of his petition. On these grounds, he sought anticipatory bail.
The State opposed the plea, maintaining that the iron scrap had been sold by the petitioner. After considering the submissions, the Court noted that the petitioner is the legitimate owner of the seized scrap, a registered dealer under GST, and has no criminal antecedents. Taking these factors into account, the Court found grounds to grant anticipatory bail. The petitioner was directed to surrender before the competent court within three weeks and, in the event of his arrest or surrender, to be released on bail upon furnishing a bond of 竄ケ25,000 with two sureties of like amount each, to the satisfaction of the A.C.J.M., Koderma. The bail was granted subject to compliance with conditions specified under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
