INDIAN OIL CORPORATION ASKED TO RENEW ITS INSTRUCTIONS TO DEALERS

In the matter of M/s. Prithvi Fabricator & Ors. ( Complainants ) Versus M/s. Indian Oil Corporation Ltd. & Ors.( Respondents ), MRTP Commission has passed an Interim order disposing of 12A Application of the complainants by the Bench comprising of Shri Justice O.P. Dwivedi, Chairman and Shri M.M.K. Sardana, Member to the effect that :

1. Notwithstanding the introduction and continuation of the scheme of channelising of the gas stoves traders / manufacturers through the respondents, the basic right of a customer of making an independent choice of the purchase of stoves for its requirement from a source not limited to the dealers of the respondents shall continue to be upheld and the respondents would renew their instructions to the dealers in appropriate and expeditious form and ensure that the prominent and appropriate display is made at the premises of all dealers of such instructions ;

2. The communications which are addressed to the consumers at the time of sanction of connections and on subsequent cash receipt, while supplying gas, bear an insertion to the effect that the consumers are not bound to make any purchase including gas stove being vended by the dealer. Such an insertions should be brought in within a period of one month by each of the dealers of the respondents;

3. A system of inspection / monitoring should be placed in position by the respondents to ensure that the above directions are being adhered to at the dealers’ level through out the country; and .

4. Respondents would additionally give publicity to the above directions in print and electronic media by way of appropriate advertisements periodically and first set of such advertisements to appear within four weeks in both the media.
