Cardano (ADA) in India: Staking, VDA Tax, TDS, FIU-IND, FEMA and Accounting

Summary: Cardano (ADA) is the native asset of a proof-of-stake blockchain that uses an extended unspent-transaction-output model and permits non-custodial delegation to stake pools. The Cardano Foundation describes delegation as leaving ADA in the holder’s wallet without a protocol lock-up or slashing of delegated principal; rewards are variable and depend on network operation, not a contractual guaranteed yield. For Indian tax year 2026–27, ADA is ordinarily a virtual digital asset under the Income-tax Act, 2025. Section 194(1), Table serial number 4, generally taxes positive income from transfer at 30% plus applicable surcharge and cess, while restricting deductions and loss set-off. Section 393(1), Table serial number 8(vi), addresses 1% TDS on consideration for qualifying resident VDA transfers, with specified thresholds and in-kind rules. Receipt of staking rewards raises a separate question from a later disposal; a blanket assertion that all staking receipts are automatically taxed only at the 30% transfer rate is unsafe. FIU-IND registration and anti-money-laundering duties concern covered VDA service providers, while ordinary individual holders are not automatically FIU reporting entities. GST on platform services, FEMA implications of overseas remittances, wallet records, cost tracing and the applicable accounting standards require independent analysis. This article distinguishes verified network characteristics, statutory tax rules and unresolved transaction-specific classification questions as at 15 October 2026.

What Cardano ADA Is and How the Network Operates

ADA is the native currency of the Cardano blockchain. Official Cardano technical documentation describes the network as proof-of-stake and explains that ADA pays transaction fees, provides stake for consensus participation and is used for deposits and rewards. Cardano also supports separately issued native tokens on its ledger; holding a Cardano-native token does not mean that token is ADA. For tax records, the token identifier, policy ID and transaction hash should be retained so different assets are not incorrectly combined.

Extended UTXO, native tokens and transaction records

Cardano uses an extended unspent-transaction-output accounting model: transactions consume specified outputs and create new outputs. A single transaction may include multiple assets, change outputs, network fees and smart-contract interactions. A bank-style list of deposits and withdrawals can therefore be misleading. The cost and consideration of an ADA transfer must be reconstructed from wallet addresses, exchange statements and on-chain data rather than assuming every outgoing movement is a sale.

Staking is non-custodial delegation, not a bank deposit

Official Cardano material explains that an ADA holder may delegate stake to a pool without transferring ownership of the ADA to that pool. Delegated ADA remains spendable and is not locked by the protocol. Rewards depend on pool activity, network parameters and delegation timing; no fixed return is promised. A stake-key registration may involve a refundable protocol deposit. The fact that staking does not lock ADA is a network characteristic, not a legal conclusion about income-tax, GST or financial regulation.

Income-tax Act, 2025: ADA Transfers and the 30% VDA Rule

The Income-tax Act, 2025 applies from 1 April 2026. Under section 194(1), Table serial number 4, income from transfer of a virtual digital asset is taxed at 30%, plus applicable surcharge and health and education cess. ADA normally falls within the broad VDA definition. The special provision permits deduction of cost of acquisition, if any, but not ordinary operating expenses or allowances in computing that specified transfer income. A loss from a VDA transfer cannot be set off against other income and cannot be carried forward under that special rule.

This is not the 20% equity-oriented short-term capital-gains regime or the 12.5% long-term capital-gains regime. Holding ADA for several years does not itself change the special VDA rate. A conversion from ADA to another token or stablecoin can be a transfer even when no rupees enter an Indian bank account. Gifts, inherited assets, protocol rewards and transfers involving non-residents require fact-specific cost, charging and reporting analysis.

Illustration: profitable transfer and a separate loss

Transaction Consideration Cost Special-rate computation
ADA disposal A ₹4,20,000 ₹3,00,000 ₹1,20,000 positive income
ADA disposal B ₹90,000 ₹1,20,000 ₹30,000 loss; not set off against A
Indicative tax on A — — ₹36,000 at 30%, before surcharge and cess

The illustration assumes two separate qualifying transfers, clear cost evidence and no special adjustments. It does not calculate TDS, transaction valuation, gifted-asset basis, exchange-rate conversion or any other tax head. Netting the ₹30,000 loss against the ₹1,20,000 profit to report only ₹90,000 as special-rate income would conflict with the statutory restriction.

1% TDS on ADA Transfers Under Section 393

For the 2026–27 tax year, section 393(1), Table serial number 8(vi), prescribes 1% deduction on consideration for a resident’s VDA transfer, subject to the statutory no-deduction provisions. The aggregate annual threshold is ₹50,000 for the specified individual/HUF category and ₹10,000 for other payers. The specified individual/HUF test refers to preceding-year business turnover of not more than ₹1 crore or professional receipts of not more than ₹50 lakh, or absence of business/professional income. The threshold is not a tax-free capital-gain exemption.

Token-for-token swaps and consideration in kind

When consideration is wholly in kind, exchanged for another VDA or partly in cash insufficient to meet the deduction, section 393 contains special rules requiring the payer to ensure the required tax has been paid before releasing consideration. In a multi-party or platform-mediated transaction, identify the statutory deductor, timing and documentary evidence. The new Forms and reporting channels must be matched to the applicable payer category; Form 141 guidance discusses the challan-cum-statement structure for specified cases.

Staking Rewards: Receipt and Later Disposal Are Different Questions

An ADA staking reward is an incoming crypto-asset generated by network participation, while a subsequent sale or exchange of that rewarded ADA is a separate event. Section 194 expressly addresses income from transfer. It does not, merely by its wording, settle every question concerning whether and when a reward receipt is taxable under another head or how its cost of acquisition is determined on later transfer. The legal position depends on the reward mechanism, control, taxpayer activity, receipt valuation, accounting and any applicable clarifications or judicial developments.

Taxpayers should maintain a reward ledger showing epoch, wallet, transaction reference, units credited, valuation method, rupee value and any subsequent disposition. For frequent commercial stake-pool operation, separate receipts attributable to services or business activity from passive delegation. A single exchange-provided annual profit figure is insufficient where rewards, transfers and token swaps have different possible tax character.

FIU-IND and PMLA Obligations for VDA Service Providers

Covered businesses providing VDA exchange, transfer, custody, safekeeping or related financial services can be reporting entities under the Prevention of Money Laundering Act, 2002 and relevant notification/rules. FIU-IND publishes AML/CFT Guidelines for Reporting Entities Providing Services Related to Virtual Digital Assets, updated 8 January 2026, and registration guidance. The Ministry of Finance announced notices against 15 non-compliant VDA service providers on 9 September 2026, showing that offshore incorporation alone does not eliminate the Indian AML compliance question when services are provided to Indian users.

A covered service provider must assess registration, customer due diligence, beneficial ownership, transaction monitoring, suspicious-transaction reporting, record retention and designated officer requirements. An individual merely holding ADA in a self-custody wallet is not thereby a VDA service provider. Equally, an exchange listing or an FIU registration should not be described as an RBI or SEBI endorsement of the token.

GST and FEMA: No Blanket Answer from the Token Name

GST treatment must distinguish the underlying transfer of a token from identifiable supplies such as exchange facilitation, custody, brokerage, subscription, software development or advisory services. Where a taxable service is supplied, classification, place of supply, value, invoicing, registration and applicable GST rate must be established under the CGST/IGST framework. It is unsafe to state that every purchase or transfer of ADA automatically attracts a uniform GST rate on the entire token value. Conversely, the existence of VDA income tax does not exempt otherwise taxable services from GST.

FEMA and cross-border wallet or exchange activity

FEMA, 1999 and RBI rules govern foreign-exchange transactions and cross-border payments. Indian income-tax treatment of ADA does not itself authorise an overseas remittance to acquire crypto-assets or make every offshore trading arrangement permissible. The legality of funding an offshore exchange, receiving foreign consideration, holding an overseas account, or moving value across borders must be checked against the actual payment route, residence, transaction purpose, authorised-dealer documentation and current RBI directions. Do not equate an on-chain transfer with an RBI-authorised foreign-exchange remittance.

Accounting, Audit Trail and Return Reporting

A business holding ADA should determine whether it is held for sale in the ordinary course, as an intangible-type resource, or in another factual capacity. Under applicable Indian Accounting Standards, inventory principles may be relevant for dealer inventory and intangible-asset principles may be relevant for non-trading holdings; Ind AS 2 and Ind AS 38 require evaluation rather than automatic classification as cash or a financial asset. For non-Ind AS entities, AS 2 and relevant intangible-asset principles must be considered with the entity’s accounting framework. Recognition, initial measurement, subsequent measurement, impairment, derecognition and disclosures should be documented and reviewed with the statutory auditor.

For tax return purposes, maintain transaction-level Schedule VDA workings and reconcile exchange TDS records, wallet movements and reported proceeds. Tax year 2026–27 is the first year governed by the Income-tax Act, 2025. Section 509 separately creates reporting obligations for prescribed crypto-asset reporting entities; that provision should not be confused with an individual taxpayer’s ITR obligation. Foreign assets and accounts may trigger additional reporting for relevant resident taxpayers depending on legal ownership and disclosure rules.

Compliance question Evidence to retain Principal risk
ADA purchase or sale Invoices, exchange trade IDs, wallet hashes, INR conversion Wrong consideration or cost
Staking reward Epoch statement, quantity, receipt valuation, later sale Misclassification or double counting
VDA TDS Payer details, deduction challan, credit statement Short deduction or missing credit
FIU/PMLA service activity KYC, AML policy, registration and monitoring Reporting-entity non-compliance
Cross-border transfer AD-bank trail, residency and purpose evidence FEMA breach or unexplained remittance
Financial statements Policy memo, wallet reconciliation, impairment analysis Unsupported asset classification

Practical Records and Control Points for 2026–27

A usable ADA tax file starts with a complete wallet and exchange inventory rather than a year-end estimate. Reconcile the opening ADA balance, purchases, reward credits, internal transfers, swaps, sales, transaction fees and closing holdings. Internal movements between wallets beneficially owned by the same person should be identified separately from disposals; transaction hash alone does not establish a taxable transfer. Keep evidence of ownership, counterparties where known, platform status and the conversion rate used for each reportable event.

Review the computation under the current Act before applying old section numbers in accounting software. The current provisions are section 194 for special-rate VDA transfer income and section 393 for resident VDA transfer TDS; former sections 115BBH and 194S belong to the earlier Act. TaxGuru’s current VDA tax analysis discusses the 2025 Act transition and the continuing restrictive loss rules. The Cardano-specific network features should nevertheless be assessed independently of other tokens.

Frequently Asked Questions

1. Is ADA a virtual digital asset for Indian income-tax?

ADA is ordinarily covered by the broad VDA definition. The precise transaction and any statutory exclusion should still be checked.

2. Does holding ADA for over one year reduce the 30% rate?

No. The special 30% VDA transfer-income rule is not replaced by the listed-equity holding-period rates merely because ADA was held long-term.

3. Can a loss on one ADA sale offset profit on another VDA sale?

The special VDA regime restricts set-off of VDA transfer losses and disallows their carry-forward. Each transaction needs separate computation.

4. Are Cardano staking rewards automatically taxed at 30% when credited?

Not automatically on that reasoning alone. The receipt and later transfer are distinct events; characterisation and cost require facts and current legal analysis.

5. Does FIU registration make an exchange or ADA itself RBI-approved?

No. FIU-IND AML registration is not equivalent to a licence or endorsement of an asset by RBI or SEBI.

6. Does every ADA purchase attract 18% GST on the full coin price?

No blanket proposition is justified. GST must be analysed separately for the underlying asset transaction and any taxable facilitation or other service.

7. Can Indian residents freely remit abroad to purchase ADA?

The income-tax law does not itself grant FEMA permission. Permissibility depends on the remittance route, purpose, residence and RBI/FEMA rules.

8. Which records matter most for an ADA ITR?

Wallet addresses, hashes, acquisition and disposal values, staking rewards, TDS credit, exchange statements and consistent rupee conversion evidence.

Key Takeaways
