The Comptroller and Auditor General (CAG) has raised several concerns over some provisions of the proposed direct tax code (DTC), the draft of which was unveiled by the finance?ministry in 2009. The country’s statutory auditor pointed out in a communication in March that some key provisions of the code, such as the ones on international taxation, could prove problematic. Official auditor CAG on Friday pulled up the Income Tax department for not being able to retain the existing tax base in 2008-09, particularly among corporate taxpayers. “The number of assessees declined by 3 per cent compared to an increase by 7.6 per cent in 2007-08. Apex auditor CAG today lamented that private telecom operators are not providing their account books to it, despite request from the government. “In the telecom sector, we have still not got access to records of private service providers despite the request for such audit coming from the government itself,” Comptroller and Auditor General of India Vinod Rai said at a conference on accountants general here.

The Lok Sabha Speaker Mrs Meira Kumar has pointed out that it was necessary to re craft the legal framework in a manner that enables the CAG to effectively discharge his constitutional responsibilities. She emphasized that the legal framework has to be suitably strengthened so that any ambiguities or inadequacies in the powers of the CAG, to discharge his mandate in the present day scenario, can be removed. In its report tabled today in the state Assembly, the CAG said, “The process of voluntary winding up of the Companies Act is much faster and needs to be adopted/pursued vigorously.
