1. The Rajasthan Tax Consultants Association vs. Union of India (Rajasthan High Court), D.B. Civil Writ Petition No. 12605/2020

As per sources The Rajasthan Tax Consultants Association has filed a writ with Hon’ble Rajasthan High Court on 19.10.2020 which got registered on 21.10.2020 for Granting extension of Tax Audit due date for AY 2020-21.

The Rajasthan Tax Consultants Association will be represented by Advocate Siddharth Ranka. Government of India will be represented by Advocate Ashish Kumar.

It is to be noted that due to Pandemic Corona most of the Offices across the country were closed for most part on or after 25th March 2020 when the first Lowdown for 21 days was announced.  Even today most offices are either not working or working at much lesser capacity due to Pandemic.

It has come to our knowledge that a Request for extension was made considering the impact on working due to COVID-19 pandemic.

Matter will come up for hearing on 02nd November 2020 as per order dated 22.10.2020.

2. The All Gujarat Federation of Tax Consultants Vs. Union of India (Gujarat High Court); Filing (Stamp) Number: Special Civil Application – No. 23375 of 2020

All Gujarat Federation of Tax Consultants have filed writ petition before the Hon’ble Gujarat High Court for extension of due dates for filing Tax Audit Report and I.T. returns for A.Y. 2020-21 on 22/10/2020. Mr. B. S. Soparkar is Advocate on Record for All Gujarat Federation of Tax Consultants.
3. The Chamber of Tax Consultants & Another Vs Union of India & Another (Bombay High Court)
As per Information received by us Chamber of Tax Consultants filed a writ petition before Hon. Bombay High Court seeking extension of the due date of filing of Tax Audit Report & Income Tax Return for Assessment year 2020-21 on 23.10.2020.

    What is the point if the hearing is scheduled for 2nd Nov?

    The Govt is deaf to genuine pleas and hardships faced by the professional bodies towards compliance.

    Even GST annual return was extended on the last day. Is there any point in this?

    Thanks to The Rajasthan Tax Consultants Association, The All Gujarat Federation of Tax Consultants and The Chamber of Tax Consultants for all their efforts and hard work !! The Government should respond immediately and extend the time for filing audit reports and the returns thereon.

    Ultimately,CBDT will extend last dates for Tax Audit after doing some farce on last date.They should think about mental condition of people who are engaged with this profession.We should not be kept in such anxiety & panicky situation otherwise incorrect returns might be uploaded.
    So many writ petitions will be filed within a few days for extending last dates,but revenue authorities should also think twice for lingering such panicky situations till last date.

    It is strange that amendments have been made as late as 1st October which are yet to be incorporated into forms utilities Despite this CBDT is playing dead in the matter of extension of last date. Where is ‘vishwas’?
