Sub: Request for extension of time to file the returns of income U/s. 139(4) of the Income-tax Act 1961 (the Act) – Unsatisfactory working of income tax computer portal and spread of another wave of Corona virus in certain parts of country

As Your Honour may be aware, the All India Federation of Tax Practitioners (the Federation in short) is one of the largest professional bodies of tax practitioners, advocates and chartered accountants – both of direct and indirect taxes. it has been functioning for the last about 45 years since 1976 and has a membership of over 9000 individuals and about 130 Tax Bar Associations located all over the country in 27 out of 29 States. The main objective of the Federation has been to provide technical inputs in the fair and just formulation of the tax laws and their fair and effective implementation.

2. Several members of the Federation have pointed out that despite their best efforts, they could not file the returns of income of some of their clients because of the poor attendance of the concerned technical staff due to the latest wave of Corona virus in certain pads of the country and also during the last two days, i.e. 30th and 31st March. 2021, the income tax portal was not functioning properly and all the returns could not be uploaded.

3. Under similar circumstances, the Central ( Board of Direct Taxes has extended the time by one month from 31st March, 2021 to 30th April, 2021 for the Assessing Officers for issuing of notices u/s 148 of the Act for reopening the completed assessments or for issuing the notices where tax returns were not filed vide Notification No. 20/2021/F.No. 370143/35/2020-TPL dated 31.03.2021. A copy of the same is attached for ease of reference.

4. The Federation has always been requiring its members to comply with the provisions of the Income-tax Act both in letter and spirit but because of the unavoidable circumstances, as stated above, it has not been possible to file the income tax returns in a few cases.

5. It is, therefore, requested that a month’s time may kindly be allowed to file the income tax returns in respect of the A.Y. 2020-21 without any adverse consequences in the form of charging of interest and/or levy of penalty.

    When there was delay by the govt in finalising the return forms upto May 2020. So Govt should extend the time limit of ITR filing . Secondly all dates on one single day, due to which the portal crashed . We are burdened so much that we cannot even fight for justice also.

    Sir Federation any Further action / Request Send to Date Extend for AY 2020-21 filing. So Many Return are left in country for AY 20-21, Every Stockholder Feel & require to Subject Date Extension. Please do more effort & campaign for that

    Why was the e-campaign notice sent to all on 29/30th March? Should have been considerate and be prepared for traffic on the tax website. Why Govt do their part in the last minute and penalise us for not submitting on time? Who will compensate for our time that we spent trying to login on their website which wasn’t responding? Just for info- I had submitted my ITR in August last year and had to revise my ITR as per the notice. I was able to submit my revised ITR at 2am on 1st April and in a rush forgot to update a few things. It is now processed and I don’t know what can I do to rectify, have to update BSR code, etc.

    I was sent email on 1st April and the last date of submission of return file was 31.03.21 as mentioned. Pl extend the date so that , I can correct my tax return.

      If time is extended the government will get late fee and interest and assessees will not loose the continuety both will get benefited

        Well the Government is already seeking means of penalising and collecting more revenue by multiple means. By making a late fee applicable for every hour of delay they can earn a sizable Revenue. Who cares about the common man sick and terrorized by this regime?

    With the Advent of CDS/DMA, instead of improvements in Indian Armed Forces, things are rather getting further diluted both for serving & ex-servicemen. Nothing is expected unless CDS, three Chiefs & Army Cdrs show some courage of convictions for rightful demands. Over subdued mil ldrship is demoralising for forces & undermines National Security.

    1. Applied for SCSS for Tax Saving for FY 2020-21 thru ICICI Bank. The bank sent SMS saying due to COVID delay will take place & have given only Provisional Certificate given.

    Last date of filing income tax server not working properly . More than 8 hrs not working. In Covid 19 situation people are affected their business again income tax return .how can they manage just think of. Middle class of people of struggling

    ITR filing date is already late, why people always rush in the last date, multiple hitting to portal slows down the portal and hampers it’s working…CA and lawyers are professionals, they should timely file their customers return. Unnecessary delay leads to only mismanagement of taxes and collection for the govt. And indirectly hampers taxpayers

      If listeners are there everybody will speak. you don’t know the ground reality and i think you never encountered with the website on last dates. Two years back some senior professionals collapsed in their offices itself because of the unbareable pressure and torture.

    What about the unlimited time being taken by the CPC to assess the returns. They also should be given a timeframe and penalised for delayed assessments. Submitted Rectification Request on 05 Feb 2021 and still awaiting for the response of CPC.

    We have uploaded number of ITR on 31 March 2021 but couldn’t upload ITR of 4 clients & in once case taxes received by us due to server down & screen shot save

    Our client shouldnt suffer for which we r responsible as tax consultant

    Why the Ministry Of Finance is stable in listening the grievances of the assesses and tax professionals as GOVT. collects the revenue through them. pls .extend the last date of filling ITR for at least one day considering portal problem on 31st March 2021

      That is sure shot a method to ensure you pay more or get penalised. The Government is not bothered whether server is down or up or sleeping or awake. You may take a costly option of approaching the Courts. Heartless Government

    Its a need of tome to genuinely support business & tax complying community to grant extended time to submit return of income for AY 2020-21 beyond 31/3/21, Income tax site was also nit working on last day 31/3/21.🙏

    HONB’LE FINANCE MINISTER IS REQUESTED TO GRANT EXTENSION FOR FILING ITR AND ALSO WAIVE OFF PENALTY FOR SENIOR CITIZENS WHO WERE UNABLE TO FILE ITR ON 1OTH JAN 21 DUE TO TECHNICAL GLITCHES OF IT WEBSITE. PENALTY BE WAIVED OFF IN CASE SENIOR CITIZEN HAS FILED ITR UPTO 31ST JAN 21 ON THE GROUNDS THAT DUE DATE OF FILING ITR 31ST JULY 20 WAS EXTENDED UPTO 10TH JAN 21 BUT NO ALLOWANCE WAS GIVEN FOR LATE FILING OF ITR.

      Dear Sir, Our laws do not grant extention of time even for persons in coma, soldiers fighting in high altitude and having NO INTERNET and sailors in submarine. Do you really hope that there will be any plausible or possible response from authorities? Even the thee Defence Chiefs are silent. The man in coma cannot get up and calculate his taxes – so confiscate his property and do a population management by reducing the total population by one.

    Dear sir. many tax payers paid their Tax only on 31st due to COVID-19 pandemic then we tried to file but due to server problem unable to file returns. Kindly look into this matter and extend.

    As there so many things going on around the globe like recession , corona pandemic everyone is under immense pressure and on top of it income tax website was not working properly on 31st. Its a request to Government to extend the date by 15 to 30 days

    Request for extension of filing the Income-tax Returns submitted to the Finance Minister is welcoming one by all tax payers because the income-tax portal was not functioning properly and all were totally upset disrespect of taking Form No.26AS, it leads them into chaos. Further the assessees who underwent to administer the Covisheild Injection had some problems of with the health condition and due to that they could not be in position to file their Income-tax Returns within the time. Hence it is prayed further one month time may kindly be extended for filing the returns and make the tax payers in a free tension mood and oblige.

    The government doesn’t know the consequences faced by the assessee, in the time of Corona 2.0,Bank merger and server problem.I think F.M has to think over and extend the date at least 10 to 15 days as assessee can file their returns for the period f.y.2019-2020.

    It is association useless people they have no any power.Goverment do what they need.This people only doing request.They was many problem merger bank not giving statement night curfew,lovkdoqn,quarantine but not understand goverment.

      mam,
      we the taxation lawyers are the backbone of the financial system of the government of the country as a whole. It is our right to get an extension of some time , because we are suffering due to technical flaws. Adjust last dates accordingly.

    Govt. Extended the date of linking aadhar and pan card and date iof ssuing notices u/s 148 suomoto. Why not extended the date of filing of ITRs when the facility was not working on 31.03.2021 i.e. peak period. The people of country requests the govt.to extend the due date immediately.

    It is only because of the reason that the last date for liking Aadhar and PAN was stipulated by the Finance Ministry as 31.03.2021 which is the deadline date for filing the return of Income for Asst year 2020-21. Many have logged into the website for linking of Aadhar at the same time and that is why the E filing server was unable to support and many were prevented from filing Income tax returns. The Finance Ministry should consider the issue and extend the dead line date to 30.04.2021

    NPAs reporting due to non-submission of audited financials will be bumped up in F Y 2020-21 only due to technical reasons and likely to adversely affect the banks NPA percentage. what a pity!!
