Sir / Madam

Sub: Request for Extension of Due date in filing the Returns of Income under Income tax act for the Asst year 2019-20 [Financial year ending 31st of March 2019] – reg.

 ****

The Due date for filing the Income tax returns was extended till 30th of June 2020 and later by one more month i.e. till 31st of July 2020 because of the prevailing Pandemic due to COVID-19.

However the Pandemic has not ended and the conditions have worsened since then. Many of the states have declared lockdown on own and the spread of the disease has multiplied because of Community spread.

States like West Bengal and Karnataka [partly] are under lockdown till the end of July. Many Districts and towns of Maharashtra are still under lockdown. Nagpur city of Maharashtra and other cities have extended their lockdown till 31st of July 2020. Buldana District in Maharashtra has already announced extension of Lockdown till 21st of August 2020.

Due Date

Various other cities and towns in various states are contemplating of imposing or extending lockdown until next month. Parts of Various cities and towns in the country are under self imposed lockdown because of the spread of the disease and the possible threat to the lives of people.

The Government itself has advised people not to move outside and in our places like Nizamabad, most of the trade associations, fearing the spread, are observing self proclaimed lockdowns and are strictly observing the lockdown rules. It is impossible to trace the victims and in some cases the Health workers [Medical Professionals] themselves are the victims of the Pandemic forcing them to shut down their Hospitals.

Many assesses who are themselves infected are either hospitalized or are under quarantine and are not in a position to discharge their statutory responsibility.

Many trade associations have imposed self lockdowns which in many cases are getting extended beyond 31st July and hence are handicapped from filing their returns.

In the States of Telangana and Andhra Pradesh too, the pandemic is not relenting and it has taken serious proportions now. The traders have been resorting to ‘self-lock down’ for preventing spread of the disease. People are living in constant fear. In view thereof, it is not possible for the traders and their tax representatives to focus on tax matters now.

In this context, we request you to take fair view of the matter and extend the due date of filing the returns as given hereunder.

The due date of filing the Returns of income may please be extended as under: –

Assessment Year Financial Year Due date to be extended to
2019-20 01-04-2018 to 31-03-2019 30th September 2020
2020-21 01-04-2019 to 31-03-2020 31st December 2020

We look forward for a fair consideration on the above stated issue.

Thank you

For Tax Bar Association, Nizamabad

The assessee are finding great difficulty due to closure of business. They don’t have money to discharge tax liabilities. The tax professionals are unable to open there offices. Due to fear factor of Covid 19 no body is in good state of mind. Some banks are not accepting challans due to fear of virus transmission. When the announcement for the extension was made for 31st July deadline there was belief that lock down will end and normalcy will return. But till now normalcy has not returned infact pandemic is spread far and wide. In city like mumbai trains are not working, staff are not in position to join work. Date for return filing for A.Y. 19-20 and A.Y. 20-21 should be extended till 31st December 2020 and Audit for A.Y 20-21 till 31st March 2021.

We file our returns through a CA. Because of the pandemic, we have not stepped out of the house for the last four months and don’t intend to do so in the coming months and have not been able to visit the bank. As the situation is showing no signs of improvement, hence the request
