CA Umesh SharmaArjuna (Fictional Character): Krishna, Income Tax Payer to whom Tax Audit is applicable has become relaxed after e-filing Income tax return on 30th November 2014, i.e. on last date. But now what next?

Krishna (Fictional Character): Arjuna, the last date for such income tax return filling is 30th September but this year due to several changes in tax audit report various high courts have extended the due date to 30th November. Almost all taxpayers i.e. Salaried, Business, Professional and Company, etc. have completed their responsibility by filling income tax Return for the financial year 2013-14, thanks to them. But some Late Latif taxpayers may file late return up to March 2015 as there is no penalty till that date for filing return.       

Arjuna: Krishna, why taxpayer wait upto last date and lakhs of return are e-filed in last 2-3 days.

Krishna: Arjuna, Income Tax department is having approx. 4,04,27,601 registered taxpayers. But amongst 2,96,81,794 taxpayers have filed returns upto October 2014 and it means large number of returns are filed in November 2014 and some will be filed upto March 2015. Behind last minute rush, there is a typical mentality of taxpayer, may think that, if books were taken to the Auditor in the last phase then the auditor may not be able to examine the books in detail and may not demand information or explanation. Further many taxpayers do not like to pay tax. Therefore this work is stretched to last date. Many taxpayers having knowledge of various laws make delay in following the laws. As in marriage house there is last minute rush, the same happens in the Auditor’s office on the last date. And in this rush technical mistakes in e-filling may occur. But hat’s off to tax experts for absorbing tension of such taxpayers.

Arjuna: Krishna, this was about the taxpayer, but now its departments turn to verify the returns.

Krishna: Arjuna, recently the Income tax department has made many changes in the jurisdiction of Income Tax Chief Commissioner, Commissioner and Income Tax offices, etc. These changes took place across the country from November 2014. In many cities new wards were created. Therefore it seems that Income Tax staff may also increase. The notification of changes in ward, jurisdiction etc. is available on the department’s web site i.e. on incometaxindia.gov.in. Due to above, changes in assessment proceeding of Income Tax Department can be seen in future.

Arjuna: Krishna, it means due to these revamping Income Tax Department is gearing up for future course of action.

Krishna: Arjuna, New government, New Finance Minister, New Working Style, New Chairman of CBDT, New website of Income Tax Department and now new jurisdictional changes, it seems that department is gearing up for future. Further due to discussions of Supreme Court on black money, the department is planning for further course of action on tax evaders. In upcoming days many taxpayer may have to face the problem of scrutiny notices. Now due to computerized technology non-filers of Income tax Return will be easily traced.

Arjuna: Krishna, Taxpayer has completed their responsibility and the officers will also fulfill their duties, then what should one learn from this?

Krishna: Arjuna, Work should be done without expecting for the results. The taxpayer should complete their duty by properly paying the taxes and the officers should also perform their duty by granting proper justice to taxpayer. The good work results in the good fruit. It is expectation of the obedient taxpayer to get the justice. Conversely the officers expect fruit of plucking tax evasion by garnering more revenue. That means both of them think opposite of each other. And this gives rise to the legal battle and the law becomes complicated. Nowadays various discussions on the black money in foreign country are going on, but what about the black money in India? That’s why it seems that the department has revamped.
