Tax Practitioners’ Association, Aurangabad has requested CBDT to extend the due dates for filing of returns by at least 2 months, in both the cases, i.e. till 30.09.2018 for non audit cases and 30.11.2018 for audit cases.

To,
Shri Arun Jaitley
Hon. Finance Minister,
Govt. of India.

Subject: Regarding extension of due date for filing ITR for AY 2018-19.

Hon’ble Sir,

It is our proud privilege to introduce our Association. We are an Association of Tax Practitioners, Chartered Accountants and Advocates practicing in Aurangabad and the neighboring districts, having a strength of 250+ members, established in 1974.

Your Honor is aware of the fact that the due date for filing the returns of income in the cases not liable to audit, for the assessment year 2018 – 19, is 31st July, 2018. For cases liable for audit the due date is 30th September, 2018. From the current assessment year, non filing of the ITRs within the due date will entail a late fees, under section 234F, amounting to Rs. 1,000 / 5,000 / 10,000, as the case may be.

In the interest of the Taxpayers and the Tax Professionals, we hereby request Your Honour to kindly extend the due dates for filing of returns by at least 2 months, in both the cases, i.e. till 30.09.2018 for non audit cases and 30.11.2018 for audit cases. We seek such extension due to the following reasons:

1. The nation is fully engrossed in GST and it is cumbersome and time-consuming process to reconcile the GST and income tax data. The reporting requirements with regard to GST in the ITRs for the AY 2018-19 are tedious and we require some more time for same.

2. The schema for the ITRs are being updated and amended in the month of July 2018 too.

3. GST returns and reporting is consuming majority of time of the Professionals.

4. As this is a rainy season, most of the parts of the country including Maharashtra are facing floods. This is making our task more difficult.

5. Overloading and slow down of the GST and Income-tax websites is creating obstacles in smooth flow of work.

6. Due date of filing E-TDS returns for the quarter ended 30th June, 2018 is 31.07.2018.

In wake of above situations and circumstances, the Taxpayers and the Tax  Professionals are finding it difficult to cope up with statutory due dates under  various Acts.

We hereby request Your Honor to kindly extend the due dates for filing of the income tax returns to 30.09.2018 and 30.11.2018 for non-audit and audit cases, respectively.

We shall always remain indebted to you for this act of kindness.

Thanking you.

Yours faithfully

For The Tax Practitioners’ Association, Aurangabad

President

  2. Aftab Alam Khan says:

Wonderful, extension for due date is so large matter relating to tax payers, but media is silent always. CNBC channel is total business channel. But no any voice of tax payer raise. Is this not a media coverage matter ? Due to absence of any agitation, any demonstration, why should media raise it. Only begging, only requesting by CA associations, taxpayers is not a solution. But they do not show on the road.

  3. Aftab Alam Khan says:

Too late to decide for extension, While a little amount of tax to pay remain, (A big amount of tax have been paid in advance). Only submission of paper is remaining part. For this work requesting, begging. This is not genuine, type of dictator ship, not an act of democracy. While all association of tax, CA, taxpayer demand for extension of due date (a little demand). It is so when man assume himself as ‘GOD’ as CBDT and this Sovereignty.

    happy noon sir
sir 5 important reason why date of tax audit and return filing date have to be extended

    1. date of normal returns filing date had been shifted from 31/7 to 31/08. and their being penalty clause imposed
it needs prior attention. so audit work postponed by one month.
    2. first year of audit under gst act . so we have to more vigil being 1st year of audit in which gst data is incorporated.
    3. 3 cd form is amended so the more clauses are their to be responded by cas than last year & for which preparation is needed
    from new angels.
    4. Audits being a work of lot judgement & planning & foresightedness the unreasonable tight schedule may cause poor
quality of service & may effect on health of chartered accountants.
    5. Their being penalty clause imposed on work of chartered accountants its important that reasonable time is given to finish
    their professional obligations .

I request our Hon`ble Finance Minister to kindly extend the due date for filing income-tax returns of non-audit cases and also audited cases in view of first time introduction of charging of penal fee u/s 234F and difficulties faced by tax practitioners and tax assessees as mentioned by other tax-bar associations are true and practical..

  19. Arun Gupta says:

Although the object is very noble to streamline the return filing within due dates, but since this is the first year of imposing penalty for the same, and habit die hard. Habit need some time to change, and therefore one more chance of 2 month is reasonable. Still it will be considered as Sept instead of next March, which itself will be a big achievement.
