Hingoli District Tax Practitioner’s Association has written a letter to Shri Sudhirji Mungantiwar, Minister of Finance, Government of Maharashtra To Condemn unacceptable statement of Shri Rajivji Jalota, Commisioner GST, Maharashtra on CA’s & Practitioners in which he said that GST site is working properly and CA’s and Practitioners have created negative atmosphere to increase their remuneration and fees for filing GST. Text of the letter is as follows:-

Respected Sir,

It is to brought to your notice that as per news published in local newspaper that Shri Rajivji Jalota, Commisioner GST, Maharashtra in a conference of Chambers of Commerce held at Nashik of stated that GST site is working properly and CA’s and Practitioners have created negative atmosphere to increase their remuneration and fees for filing GST which is quite unacceptable. We as a GST Practitioners feel that this irresponsible statement of Shri Rajivji Jalota is to hide the shortcomings of GSTN network to provide suitable facility to file return and other compliances.

Since Introduction of GST act, We Practitioners had widely supported for implementation as well as migration from existing Indirect tax laws applicable in the state. We have continued our efforts even though there were many Technical Glitches like System errors, system failures, System not responding, down for maintenance and invested our lots of time for GST Work. We have been proved as fools to invest our valuable time and being shown as culprit for failure of GSTN Network.

We as Practitioners condemn this unacceptable statement of Shri Rajivji Jalota and demand an unconditional apology from Shri Rajivji Jalota otherwise we will start our agitation against such irresponsible statement and also stop filing GSTR Return and other GST Compliances.

    the failure in implementation of so many schemes/projects are only because of this type of bureaucrats who never work and only blame others.

    STILL I CAN’T FILE JULY GST RETURN
    DAILY PENALTY LEVIED RS. 200 PENALTY
    WHY U DID NOT BUILT BETTER SOFTWARE
    IN INCOME TAX THE EXTEND ONE MONTH AND NO INTEREST AND PENALTY FOR TIME EXTENDING IN MANY TIMES
    BUT GST WHY NOT

    I challenge your statement with proofs. I have saved screen shots of various issues faced on GST site.
    If you don’t Know, let me tell you, we are not after money. Many of us are at verge of breaking point
    due to unbearable pressure and you say we are doing this to extract fees.
    You must apologize for your own good.

    The comments of Commissioner is most irresponsible and highly unbecoming of a top bureaucrat, knee jerk reactions from CA fraternity will not serve any purpose. The matter has to be escalated to the highest level. We and public need solutions and not display of arrogance and attitude by bureaucrats now.

    GST Commissioner is not wrong. Many CA’s putting conditions to other Practitioners and business assistants to put the entire file and assignment to CA only asCA is only authorised for all including audit. Many are threatening the assistants to sit in there offices to upload the data from their desktops. This is nothing but National building by bulldozing others. Shame on those CA’s always call themselves partners in National building.

    It is very easy to comment on others. But sit on their place to do the work, is not easy joke. Nowadays Govt. has good practice, that Auditors are most responsible for assesses business mistakes. We can see the Govt imposing rules from ITax side or from GST side. ” I am not a C.A person but assistant only.

    The person who is blaming should first sit with the system and understand what sort of problems Dealers/Assessees are coming across?. Then one can understand whether we should blame CAs or Dealers or the authority responsible for it. Blaming one and another will not serve the purpose. Everybody should understand their role before blaming others. Then the spirit of any law can be taken in the right directions.

    If that be the case, why the Govt. had deferred the due dates several times for various returns and indefinitely for Aug.17 return onwards? Every citizen is watching closely the affect of GST and it is not alone professionals and business houses.

    It is shameful the way Mr. Jalota has blamed the professionals. CAs have a better standing than the bureaucrats in the eyes of a common man, because every one knows what it takes to become one. It is also known to the people the way bureaucrats in India work, so it does not really matter.

    It is always easy to blame professionals rather to raise a finger on their own Govt. I think the Hon’ble Commissioner should first file gstr1 return of assessee by himself only then he can realise the truth.

    Let us all do what they did in indore take one gstr 1 to help desk and tell them to upload it in the prescribed time that commissioner says that portal can upload it even json file is not being created so easily

    This is only the problem they are not ready to take responsibility that yes GSTN is not working properly…
    They should accept their mistake and give responsibility to someone who is capable of doing this

    Just to take credit from PMO and to cover up his short Comings he should have simply passed on the buck on CAs and Auditors. He should know that without CAs nd Auditors they can’t run the show Pls bear it in mind Mr Commissioner.

    These butocrats are unaware of what is going on ground levels, how much required to struggle to comply with one stage ofcompliance. As the governent machinery is failed to provide the required support and solve the problesms. When we visit GSTN office with difficulty, they are aunable to resolve it. The small business people who have taken GSTN, they are not bothered about compliances, we are wasting our time for success of GST even though our fees are not paid. So such irresponsible statement is not expencted from commissioner.

    Why not government asked its employees to open centre and help dealer to file returns then only they Will realised how money is earned ny hard work and just by shaking tongues things do not work

    Mr Commissioner, should not forget that the Govt officers and CA or any other tax professionals , under GST Digital environment, are seating in the same boat, which is sailing in very turbulent digital environment .

    And as a rule of physics , action and reactions are equal and opposite , as such the boat may sink, if any one of the two carries more weight or makes the boat imbalanced with such strictures on professionals , which needs to be condemned..

    I think words of wisdom will prevail with govt. dept , especially for CA and practitioners, who have made their job of GST Implementation very easy from the first day of its incubation till implementation.

    Dear brothers,
    i india only Govt officers and beurocrates are faithful and are honest all others are chor thefts because they full tax on there salary income except their hard earn daily MEHNTANA( VEVHAR IN GUJRAT) and bribe as it is tax exempted and not accounted as their income.it is earned with hard work and over looking various govt rules.so the can say any thing to any body.govt is in their full support.

    Commissioner should apologies. We as practitioner are helping government to smoothly file the returns and in return they are criticizing us. Their network is not ready and for that they are blaming practitioners. Such a shame for officials as they are hiding their inabilities.

    to please whom the Commissioner has given such statement? It seems that he is a politician and not an officer. Either CA or any other tax professionals are the back bone for the success of any change in the taxation system and work almost 15 hours a day non stop and make the tax collection smooth for the government.Under these circumstances such a statement from a commissioner is not warranted.
