Subject: Extension of time limit for submitting the declaration in FORM GST TRAN-1 under rule 117 of the Central Goods and Service Tax Rules, 2017
In exercise of the powers conferred by rule 117 of the Central Goods and Services Tax Rules, 2017 read with section 168 of the Central Goods and Services Tax Act, 2017, on the recommendations of the Council, and in supersession of Order No. 07/2017-GST dated 28th October, 2017, except as respects things done or omitted to be done before such supersession, the period for submitting the declaration in FORM GST TRAN-1 is extended till 27th December, 2017.

All registered persons under GST who want to avail credit by filing TRANS 1 be provided one more opportunity to file TRANS 1. Small traders had to face lot of hardship under GST regime, unless Govt supports it will be very difficult.
It is difficult to understand what Government is gaining by not allowing users to file revised Trans 1 inspite of knowing their system glitches. The Government is thus encouraging malpractices to follow instead of allowing tax payers to file their return and show transparency.

The petitioner seeks a writ of mandamus directing the GST council
respondent no.2 to make recommendations to the State Government to
extend the time period for filing of GST Tran-1 in the case of the
petitioner because his application was not entertained on the last date
i.e. 27.12.2017 and he has filed his complete application for the
necessary transactional credit.
The petitioner has alleged in the petition that despite making several
efforts on the last date for filing of the application, the electronic system
of the respondent no.2 did not respond, as a result of which the petitioner
is likely to suffer loss of the credit that it is entitled to by passage of time.
It is the petitioner’s case that he has also submitted his application for
transitional credit manually on 10.1.2018. The respondents were served
with a notice on 19.1.2018 with a copy of the petition and they have also
obtained instructions today. They say that portal is likely to be opened
but is unable to say that when the portal is likely to be opened.
In view of the above, the respondents are directed to reopen the portal
within two weeks from today. In the event they do not do so, they will
entertain the application of the petitioner manually and pass orders on it
after due verification of the credits as claimed by the petitioner. They will
also ensure that the petitioner is allowed to pay its taxes on the regular
electronic system also which is being maintained for use of the credit
likely to be considered for the petitioner.
With the aforesaid directions, the the writ petition shall stand disposed of
finally.

THE GST Site was not accepting the Return in Form 1. Inspite of best efforts, TRAN 1 could not be filed on 26th and 27th December, 2017, the last date of filing.

Govt. is just harassing the small and medium enterprises with its complex GST software. It should not collect late fee. If it collects, then it should not have any time limit or deadline.

Many offices may aware about the TRAN 1, but do not know how to apply, where to apply. If we approach central offices they were busy with their own stuff. Moreover, TRAN 1 due date was clash with VAT 240 audit. By considering these practical issues we are requesting to GST council to extend TRAN 1 due date for reasonable period.

Date of TRANS 1 should be increased upto 31.03.2018.Firstly Govt should check that whether all the states have issued C forms up to 30.06.2017 to all its vat registration holders.If it is checked govt will come to know that most of the states have not issued C forms till date which is the main reason for non submission of Trans 1. Since some newspapers have told that last date of TRANS 1 was 31.12.2017.This was also the main reason the clients and advocates were confused about the last date.

the blunder mistake of the portal is they have not fixed the options to filling tran 1 with late fees or with penalty and due to this so many peoples feeling stress and its seems like unfair with the innocent taxpayers this situation is very painful for both owners and professionals who fail to file there tran-1 we hope govt should take action on this matter as soon as possible.
According to law the extension of time limit for tran1 is 180 days which is complete so for further extension you have to wait friends becz this time for extend the date govt is required need to amend the law if they not extend the date they will provide some other solution dont be panic there are still so many peoples are left to file there tran1 becz of publication of date 31/12/17 on Gst council site higher authorities are saying just to wait to sort out this problem. till time you can mail to gst helpline for all this matter and in email please mention your pending itc for both vat and excise.also cc to gst council and pmo office to raise your voice.

Kindly extend the date of Filing of Trans 1 form since lot of C forms are still pending with many states and the customers are not providing C forms. But people are awaited to get whole amount in one shot. Now are in trouble, and it was not very lengthy or troubled form to fill, it is easy and since from last 50 days, site is also worked fine, so filling TRAN 1 not done due to site problem is not fact.

It may be one reason not to file tran1 but not for all asesse and there is no prob to extent the date assesses who had paid the vat tax will be benefited with the same it is must for welfare for the assesses, reasons may be vary for person to person thanks

This is a written petition filed before the Hon’ble GST Council up on considering the below given details or the common problems faced during the filing of GST TRANS – 1 and hereby most humbly urged before this Hon’ble Council on behalf of all the Registered Dealers/ Suppliers and the Professionals community to extend the date for filing of GSTR TRANS – 1 at least for 2 to 3 days and thereby give an opportunity to file the same due to errors as reported below by the GST Website and due to other issues most of dealers have failed to upload the GSTR TRANS – 1 details for stock held with them.

Under these all situations the Government has ended up the last date of filing Trans – 1 on 27th of this month and is not justified and it has to give some more time to file the TRANS 1 by extending the due date for filing of the same at least of 2 to 3 days.

Major issue is in Delhi, where officers are not co-operative and delaying the required forms to issue and due to pending Forms company end up paying money for those pending. not fare with GST implementation. Tran 1 filing should be extended till end March 2018 and check with all states on pending C,F,H….forms and directive should be given to officers to clear them on priority.
Hope the authority will look into the matter of extending the due date of filing trans 1 by at least 30 days

tran 1 to be extended as most are in mood of festive n new year mood. Adding to this server is also not supporting. Pl extend another 30 days.

Can extend this date 27 December 17 for filling Trans-1. Because, Vat audit is important and filling of Trans-1 is based on Vat Audit vat credit carry forward in next year.
