Sub: Vigilance Set up for Department of Trade & Taxes.

VIGILANCE ORGANIZATIONAL SETUP

The Vigilance Organization in Deptt. of Trade & Taxes is headed by Commissioner of Trade and Taxes, who is assisted by Spl. Commissioner/ Addl. Commissioner for vigilance matters.

The Department is following Central Vigilance Commission,  (CVC) guidelines for enforcement of anti corruption measures in the Department and for implementation of instructions/ guidelines issued by CVC for maintenance of integrity in public services.

RECEIPT OF COMPLAINTS AND CATEGORISATION

Any information related to corruption, malpractice or misconduct on the part of public servants, from whatever source, would be termed as complaint. Accordingly, the  petitions/ complaints/ source reports sent by the Central Vigilance Commissions CBI/ Directorate of Vigilance, Govt. of NCT of Delhi and public complaints are to be examined with due care at the level of senior officers.

The complaints received form the public and other sources interalia include complaints, which. provide particulars of complainant, as well as anonymous or pseudonymous complaints.

PROCEDURE FOR DIFFERENT CATEGORIES OF COMPLAINTS

Disposal of complaints is done as per procedure laid down by CVC. As per the CVC instructions, no action is to be taken by the administrative authorities on anonymous / pseudonymous complaints received by them unless the facts are prima facie verifiable. In case of complaints containing particulars of complainants facts may be verified from the complainant and if the complainant cannot be contacted at the address given in the complaint or if any response is not received within a reasonable period, the complaint may be presumed to be pseudonymous and should be acted upon accordingly.

If the complaint is of verifiable nature .then comments are to be obtained from the concerned functionaries through respective Supervising Officers. In cases where investigation is to be done on the basis of additional inputs from the complainant, the complainant is called for hearing and substantiation cf complaints. Depending upon the outcome of investigation/ enquiry, if a prima facie case is made out, disciplinary or criminal proceedings are to be initiated against the delinquent Govt. servants with approval of Competent Authority/ advice of the Vigilance Deptt. of Govt. of NCT as may be applicable as per CVC norms.

The VATO (Vig.) shall be responsible for maintaining records of all complaints received and ensuring prompt action upon all complaints. The Complaints register shall interalia contain the following columns:

Provided that a separate Complaints Register shall be maintained for Gr.A Officers which shall remain in custody of Addl. Commr. (Vig.).

TIME FRAME FOR DISPOSAL

The following time frame shall be generally observed for disposal of Complaints and follow up measures.

PREVENTIVE VIGILANCE ACTIVITIES 

  1. Procedures rules, regulations are placed on the web-site with special focus on increasing transparency.
  2. To reduce the interference of unauthorized persons in day to day working of various branches, the entry/exit points of Vyapar Bhavan have been reduced and scanners have been installed at entry points
  3. Bi weekly inspections are conducted jointly by HR & Vigilance officials to check punctuality and also to ensure that officials are working as per standards of discipline and integrity expected of them.
  4. Process of e-tendering has been revised to check pooling of tenders.

    Although more than one month is over yet there is no response to my above complaint. It appears that no action has been taken by the concerned department.
    May I request for response in the matter at the earliest.

    Single Die Dona Paper Machine against Invoice No.231 dated 23.01.20017 for Rs.67,500/- gas been purchased from Jyoti Paper Plate Manufacturing Pvt. Ltd. D-248/10, Balaji Complex, Office No.30, Laxmi Nagar Metro Station Gate No.1, Delhi-110092. The Invoice include amount of Rs.7500/- towards VAT charges. Their TIN No.is 07386915393. The above company is in the business for the last several years. It appears they are maintaining parallel Invoice book and not depositing VAT amount so charged in their bills to VAT Department and thus siphoning off the funds. It is requested that our complaint may please be looked into at your end and records of the company with reference to periodical returns submitted by them, if any, be verified and action taken against them. The company at its web site has shown that their annual turnover is over Rs.50 lakhs. A line in confirmation of having received the complaint will be highly appreciated.

    We had purchased Single Die Dona Machine from Jyoti Paper Plate Manufacturing Pvt. Ltd., 248/10, Balaji Complex, Office No.30, Near Laxmi Nagar Metro Station Gate No.1, Delhi vide Invoice No.231 dated 23.01.2017 for Rs.67,500/- i/c. Vat of Rs.7500/-. TIN No.shown on Invoice is 07386915393. There is every apprehension that Shri Ravi Singh, Director of the above Company is maintaining duplicate Invoice Book to siphon off the amount charged therein. The Company is engaged in the manufacturing and trading of different type of Dona Paper Plate Machines in India and Overseas Countries. He opens his office for limited hours in the afternoon. Kindly look into whether above TIN No. is in name of Jyoti Paper Plate Manufacturing Pvt. Ltd. and whether he is depositing VAT amount so charged from the customers with the VAT Department particularly when the Company is registered with ROC and doing business for the last several years.

    I know the details tha some firm booked the fake invoice and taken the benefit of input tax 20% and sales against cst 2% then take both benefit input and output also (input 20% and output 2% diff is 18%)

    rest amount distribute in cash among the party

    so please suggest me i do the complaint or not

    if i do the comlaint against this company then what will benefit get me.
