Notification – New Delhi, 20th April, 2010

G.S.R. (E)- The following draft rules further to amend the Employees’ State Insurance (Central) Rules, 1950 were published as required under sub-section(1) of section 95 of the Employees’ State Insurance Act, 1948 (34 of 1948) in the notification of the Government of Indian in the Ministry of Labour & Employment vide No. G.S.R.164 (E), dated the 26th February, 2010, in the Gazette of India, Part II, Section 3, Sub-section (i), dated 27th February, 2010 for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of thirty days from the date on which the copies of the Gazette of India in which the said notification was published, were made available to the public;

And whereas the copies of the said Gazette were made available to the public on 27th February, 2010;

And whereas, objections and suggestions received from persons likely to be affected thereby have been considered by the Government;

Now, therefore, in exercise of powers conferred by section 95 of the Employees’ State Insurance Act, 1948, the Central Government, after consultation with Employees’ State Insurance Corporation, hereby makes the following rules further to amend the Employees’ State Insurance (Central) Rules, 1950, namely:?

1. These Rules may be called the Employees’ State Insurance (Central) Amendment Rules, 2010.

2. These shall come into force from the 1st day of May, 2010.

3. In the Employees’ State Insurance (Central) Rules, 1950, in Rule 50, for the words “ten thousand”, wherever they occur, the words “fifteen thousand” shall be substituted.

    my salary is 15001. and my company is deducting PF twice and Esic twice from my gross salary and saying 100 % PF will be deducted from my salary but ESIC also is twice …
    can anyone help me out ????

    My CTC is 15000, Still the ESIC deducted from my salary as 632 from CTC and 232 from my basic salary.
    Is this correct? I guess ESCI should not be deducted from 15000?

    AS PER ESIC RULES ESCI LIMIT 15000 ESIC WILL DEDUCT IF GROSS SALARY 15000 & BELOW 15000.OK. IF YOUR SALARY ABOVE 15000 SO COMAPNY MUST NOT DEDUCT ESIC . IF COMPANY ARE DEDUCT ESIC AT ABOVE 15000 GROSS SALARY . SO TWO THINGS WE SHOULD BELIEVE THAT E NOT COMPANY ARE CHEAT HIS EMPLOYEE / COMPANY MANAGEMENT AWARE TO RULES OF ESIC WE CAN DO OUR FOR INCOME SAFATY WE SHOULD ADVISE GOOD ADVOCATE ABOUT THESE & WE SHOULD DEMAND OUR RIGHT OF SAFETY WITH CHEATER COMPANY TO GOVERNMENT OF OUR STATE .

    Myself vasudev, I had gross salary 7000, basic 3500, epf-0, esic-455.
    i want to know is it fair to deduct esic 455? i asked hr she was telling 1.75 from employee and 4.75 of employer both deducted from my salary.

    ESIC scheme per se is day light robbery by the Union Govt.Who is benefitted only ESIC inspector jokers and their directors.ESIC dept should be called Saddam or Gaddafi depts.It’s rules and conducts are amounting to exhortion.ESIC should be made optional.Govt. Cannot force or cannot make employees and employers to pay contributions through their noses.ESIC inspectors most of them or idiots and ver corrupt.They are rude,crude,argumentative and quarrelsome.

    ESI dept. is totally corrupt and has insane guys as inspectors.They cannot bend thier back to bring establishments that employ more than ten people with power.They cover establishments that have 4 to 5 employees and trouble them.They send already covered notices with assumed employees.Torture the owners of the units.They fleece in the name of contributions.Bribes are exhorted by blackmailing and threatening.ESI inspectors Nagaraja and Gajanana are notorious and are like cunning foxes.They have no concious or heart.These heartless perosns have covered even tiny units and made them suffer lakhs of rupees losses by wrong coverage and exhortion.Shamesless people.

    It is very difficult to invest money in business and survive.This country is for law breakers tahn law abiders.Whole system is corrupt and every one wants exhort money.This ESI Dept. is one of the worst Dept.Here inspectors cover or do not cover depending the graft they rceive.ESI dept. shiuld be closed.This only benefits ESI Directors and EsI inspectors and thier legal teams

    CVC has done good jobs but prevent 2 G scmas like scams.Govt. instead of punishing the guilty were indirectly helping the accused.No matter what political compulsions they have has no bearing on the citizens of the country.Sonia or Congress is not India but are custodinas.Their conduct should be like that.

    ESI rules and regulations are antique.You need to revise and make them modern.Thee should not be any compulsion.This dept. also should be privitised.ESI inspectors are totally corrupt,argumentive and arrogant.There should not be enforcement but systems should attract more employers to insure their employers.Now employers avoid ESI because of their corrupt and arrogant inspectors.Make ESI Private like Telephone and mobile.Let private players also give competition to this white elephant ESI.Corruption and harassment at this so called ESI inspectors(BUNCH OF JOKERS)

    CVC can definitely do better jobs.But govt. officials and thier collegues will not co-operate.In Bommasandra ESI Regional office in BTM Layout has set of corrupt inspectos and directors.They are like Jugs and its Lids.They support each other.They cover evven samll units with 6 to 8 employees even if the salary salb is much higher than Rs 16,000-00.They send letters covering the units with assumed employees by taking a signature wwith for seal of the company start harassing the owners with inspection and post inspection slapping demand notes and recovery notices to the tune of lakhs.There is no appeal mechanism at all.ESI dept is the only loot for all without any accountability with their staff.Here inspectors and Directors all behave the same petty way and fleece the business owners.ESI dept. should be disbanded as its existence is not worth.

    ESI inspectors and thier dept. is very high handed.They do not follow even high court or ESI court orders.They have no respect for their own laws.Each inspector will interpret the law in his own way.They allow litigations to crop up even for small amounts to help their advocates who charge lakhs of rupees for few thousands of claim.ESI Dept. loots money from the public,business owners and from the govt. without any reason or rhyme.There is no accountability at all.No difference in the attitude in the hierachy.

    There is nexus between ESI Advocates and ESI Inspectors with their legal section.Even for unreasonable claims they claim and keep slapping notices and recovery notices.Ones their torture will be such to approach courts.They resort to these type of tortures to help their advoacates to get some cases so that they cn charge the dept. royally.The extra earned amount will be shared by all the so called Chinta se mukti officials.Their financial chinta will get mukti by such dubious means of coverage,false and wrong claims and ultimately push units to approach courts and finally rip the ESI dept. with bloated bills for advocates and then share the booty.

    ESIC dept. is anti busienss and antiemployers.They soem antique laws and their inspectors are very crude and irritating.They lack PR skills.They are argumentive and quarrelsome.This they resort to extract more bribes from you.When they get correct remittance everymonth without much variation they must keep quite.Why order for records inspections and extract more bribes.India is a nation of looters without any windows for resolving the issues amicably

    very poor performance. only 123 the officials perhaps visited only one or two offices. please visit several more and make this figures in lakhs then follow up for their latest position whether they went scot free or penalized. otherwise there is no meaning of issuing such lists. it is just an official exercise.

    Upto March’12 month my gross salary was Rs 14700/- I have received increment effected from Apr-12, My revised gross salary is Rs 17,960/- Although ESIC is deducted from my salary of apr, may,june & July. and company replied that it will be deduct till end half year (Apr to Sept.)

    You know what? Who terrorists are created right here…. I earn money for not for all these ESI and shit . Hand me a gun why won’t I would love to kill whoever responsible for this? When we never ever ever ever ever visit ESI facility then why the hell it is deducted from salary…? And where the hell are ESI hospitals? if they are near my home thats alright but if its 10KM away from my home wats use of it??? What the hell is compulsion?? why can it be optional?
    Why don’t the govt. take voting for this? Do GOVT think this act is for citizen if yes ask them if they are happy?

    Every one says I’m proud to be Indian.. who then hell say’s that he/she is proud of the Govt running India….?

    Hi Raju,

    The max ceiling limit is Rs.15000/- only. If it more than that there will be no deductions. Its basically deducted on gross. As you said your salary hiked from 1.44 to 2.40, then there will be no deductions from your salary.

    Kindly check with HR & get confirmed.

    Am Raju working for a software company as an Office admin. In the month of october my salary is revised from 1.44 to 2.4 lakhs. Relate to this previously am coverd under ESI so am able to cancell that ESI if not the ESI deductions is applicable only on ceiling limit of 15000/- or whole 20000/-.

    Pls help me in this matter in my company they have deducted the ESI on whole amount of 20000/- not on 15000/- i.e 1300/- instead of 975/- is this right or ?

I am corporate employee and getting salary 30000Rs/month and yesterday I received one mail from my Managing Director, he written that from 1st April onwards ESIC will deduct from your salary just please reply me, can be ESIC deduct from my salary or not? As per my knowledge ESIC charge can deduct only upto salary limit 15000Rs/Month only. But how is it possible in my salary of Rs 30000 so please request to you please reply me ASAP. Regards.     i have a question related to esi deduction in my salary. can any1 plz help me???

    i m working in a BPO fpr 1 year 2 mnths and suddenly frm last 2 months my ESI is getting deducted. When asked why is my ESI getting deducted the answer is it was nt deducted earlier so they are recovering it from my salary now.
    my salary for 1 year was 13500/- after deductions and nw is increased bt 3000/-. From month of nov my sal is 16500/-

    plz help me is this rite tht they are recovering the ESI nw????

    EMPLOYER’S CONTRIBUTION IS ALSO DEDUCTED FROM EMPLOYEE’S (OUR) SALARY.

    i am very very frustoooooooooo…

    I am truely not happy with this rule.Suddenly a huge deduction in salary turns our happy life into tensed life.

    On one hand the govt has increased the inflation including the rate of ricks & buses,petrol, diesel, etc. & on the other hand the same govt has come up with a rule of deduction of esic from our hard earned salary which is compulsary. I guess this can happen only in India where the govt does not care about their own citizens. I believe India is a democratic country & we as citizens should be taken in confidence before implementing such rule. The govt only wants to make money from our hard earned money which is totally wrong & citizens of this country should object on this policy. According to me this policy should be made optional & not compulsory. I as an individual cant make change but if we stand united we can make change. So guys come forward to stop this dictatorship of our govt.

    My income falls in the ESI category but i do not want my salary to be deducted as it would only decrease my net salary. My husband already gets a veru good reimbursement for medical. Is it possible that this amount is not deducted from my salary.

    i am trully unhappy with this move of government…why they are making it compulsory for Pvt co’s to give good hike when market has improved..we didnt get any hike last year..this year again the same story and after everything they started deducting for ESI which is really irrelevent for me.. we have such a limited budget that cant afford such deduction.. i agree with people who think that govt should make it optional..atleast we can refuse this deduction. even if we fall sick would not go to ESI hospital.

    Its really ridiculous & burden policy introduced by govt. m really unhappy from the day my salary is getting deducted without any use. I am a student beside work to fulfill my education expenditure & use to take self conveyence & work hard although my company provide cabs but i do this only to earn more, but now my budget had gone vest due to this new policy. This is totally useless for me. I had withdraw myself from one tution class as my budget is not more so as earlier. As per me govt. should introduce new policy rules & benefits as per requirment but should not abide in it, it should be optional not likely to be burden for general public so that everybody can avail it & be happy not live a tensed life. so my only request to govt. that govt. should once more think on this matter & do the best for general public.

    This is good or bad I don’t know but suddenly this activity by govt. will harsh all . I personally feel — everyone has their commitment from their salary & suddenly if they start deducting Huge amount from salary it will be a very pathetic situation.
    My suggestion is to make this thing optional.If someone want HE/SHE can opt.
    Govt should consider this issue once again.

    Whether ESI will be equivalent of CGHS ? Can the retired employees (including the spouse) take the benefits even after retirement like the CGHS?

    ESI can be equivalent of CGHS, so that there is no ceiling. If ESI can be parallel to CGHS, it will be a boon to the large number of salaried class especially for the retired salaried class.

    Though it seems an extended benefit to the employees, they are the sufferers also. Revised limit makes them bear a sudden deduction towards E.S.I from their salary. Some private companies, who had not been allowing Medical Allowance to those employees whose salary was above 10K but below 15k,(prior to this revision)now stick to the compliance of the ESI Act and are going to deduct some amount from their salary all of a sudden as per the Act.

    The E.S.I – Department should also pay attention on the issue whether the employers allowing any Medical Allowance to their employees whose salary is above 15K or not.
