The ESI Act 1948, encompasses certain health related eventualities that the workers are generally exposed to; such as sickness, maternity, temporary or permanent disablement, Occupational disease or death due to employment injury, resulting in loss of wages or earning capacity-total or partial. Social security provision made in the Act to counterbalance or negate the resulting physical or financial distress in such contingencies, are thus, aimed at upholding human dignity in times of crises through protection from deprivation, destitution and social degradation while enabling the society the retention and continuity of a socially useful and productive manpower.

The Employees’ State Insurance Act 1948 (the ESI Act) provides for medical, cash, maternity, disability and dependent benefits to the Insured Persons under the Act. The ESI Act is administered by Employees’ State Insurance Corporation (ESIC). Benefits provided under the ESI Act are funded by the contributions made by the employers and the employees.

The Government of India in its pursuit of expanding the Social Security Coverage to more and more people started a programme of special registration of employers and employees from December, 2016 to June, 2017 and also decided to extend the coverage of the scheme to all the districts in the country in a phased manner. The wage ceiling of coverage was also enhanced from Rs. 15,000/- per month to Rs. 21,000/- from 01.01.2017.

Current ESIC contribution Rate:

Employers’ share: 3.25%

Employees share: 0.75%

Changes in ESIC with effect from 1st October, 2019

  • Employees must be registered online on the date of appointment; the online system shall allow maximum 10 days to register the new employee.
  • Employee will have to collect their Biometric ESI Permanent Card from nearest Branch Office.
  • Contribution against employee must be deposited within the due date. You shall not be able to deposit contribution online after 42 days from the end date of the contribution period.
  • Employee whose per day salary is Rs. 176/- or less need not to pay Employee’s contribution and the same will be paid by Govt. However, Employer will have to pay their share of contribution.

    I have got an opportunity to work as a contractor. PF & ESIC is compulsory to get the work. When I am registering online portal I have mention the date of commencement. I will be starting the work only after June 2020. However I have registered the company and I have the registration certificate. Can I mention the registration of company date?

    Sir,
    I have not able to deposited the ESIC of my one staff for the month of July 19 August 19 and September 19 before 11 Nov 19.
    My consultant has deposited these wages in miscellaneous wages for the above mentioned .
    periods.
    But no of days not showing online , in this connection IP not getting the super specialty treatment as IP wife suffering from kidney disease and she is having dialysis from last 2 years as this is not a employe fault .
    Plz give suggestions.

    2. Suppose employee get recruited on 1st November 2019 and comes to light 5th of December while making salary in December 2019
    3. So here while making ESIC challan ECR you need to register your employee on 26th of November 2019 and need to add gross salary of November 2019 from when employee joined
    4. Now as you know ESIC portal automatically will calculate the November 2019 & December 2019 employee contribution for ESIC
    5. One more help here you can also get the compliance for November & December in records without any penalty

    Sir how to register employees appointed before 10days as my establishment got registered under esic in October,2019 and my employees were appointed in my establishment in 2017. The portal is not accepting the appointment date,it says registration is resticted till 10days from appointment.
    What to do sir?.how to registered and generate IP number for the employees appointed earlier.? Please Help.

    My question is then how will the contribution be deposited if 42 days has lapsed? Will it be deposited offline or can not be deposited at all? What will be the consequences then?

    Really it is a matter of regretted that without notification in the ESIC portal, on line registration procedure has been changed. How it will be managed if the contribution is already deducted before registration.

    Sir, New establishment registered as coverage w.e.f. 01.10.2019 how can we enter the employees for registration after registration certificate received after 31st october,2019. Is it possible register the new employees as appointed as on 01.10.2019(coverage date 01.10.2019). Kindly clarify. If system not allowed the above employees’ registration how can we do. Kindly clarify
