Subject:- Benefit of 2 Years weightage of Service to the members with 20 or more years of pensionable service under Para 10(2) of Employees Pension Scheme, 1995 —reg.

Sir,

Attention is drawn to Head Office letter No. Pension-I/3(4)16/7915 dated 25.07.2016 and letter No. Pension-I/3(4)16/2/15850 dated 20.05.2016 on the above cited subject. Still various communications are being received by the Head Office from pensioners relating to the grant of benefit of two years weightage. Hence, in continuation of the aforesaid letters, it is clarified as under:

Para 10(2) of EPS, 95 was amended vide G.S.R. 546 (E) dated 23.06.2009 (w.e.f.24.07.2009). After amendment the Para 10 (2) reads as under :-

  • In the case of the member who superannuates on attaining the age of 58 years, and who has rendered 20 years pensionable service or more, his pensionable service shall be increased by adding a weightage of 2 years.

Prior to amendment para 10(2) stood as under :-

  • In the case of the member who superannuates on attaining the age of 58 years, and/or who has rendered 20 years pensionable service or more, his pensionable service shall be increased by adding a weightage of 2 years.

After amendment that is w.e.f. 24.07.2009 a member is eligible for benefit of 2 year weightage of service provided :

i. He superannuates on attaining the age of 58 years and

ii. He has rendered 20 years pensionable service or more.

Prior to the amendment that is upto 23.07.2009 a member is eligible for benefit of 2 years weightage of service in the following three conditions :

i. Member superannuates on attaining the age of 58 years and has rendered 20 years pensionable service or more.

ii. Member superannuates on attaining the age of 58 years.

iii. Member has rendered 20 years pensionable service or more.

Thus, where the date of leaving service is before 24.07.2009 benefit of 2 years weightage of service will be given even if a member had opted for pension before attaining 58 years of age, as informed above.

In this regard necessary changes have been made in the application software and the war has been released to all field offices on 27.03.2017.

In light of the above, it is requested to take necessary action to dispose off all references/grievances pending at your end.

(This issues with the approval of ACC Pension)

Yours Faithfully,

(Mukesh Kumar)

I have joined as EPF member on 01.10.1990 and i have voluntarily retires from service 31.12.2011.
since 01.01.2012 I am drawing Rs.1414 as reduced pension (In between my service, I have got 25 days as NCP). Now please clarify the Weightage Pension as How Much and from when it will be appliable. Kindy reply for this query.

      Sir,
I have applied for reduced pension after completing 56 years of age. My total service was 25 years, in which pensionable service was 20 years 29 days. But , in PPO , it was mentioned that weightage service was menioned as Zero.

Whether in calculating Reduced Pension, weightage of 2 years service applicable or not?

Please clarify sir and send the same to my e-mail ID: sriniwas2003@gmail.com

  5. Sanjeev Vaidya says:

    Sir,
    1. I took retirement in 2007. Initially my original pension was fixed on Rs. 1328/-. Since I commuted 1/3rd pension, monthly pension after commutation was computed as Rs. 885/- ( 1328-443).90% of this i.e. Rs. 796/- was fixed as my monthly pension. I received commutation amount of Rs . 44300/-.
    2. After awarding benefit of weightage of 2 years, my pension was fixed on Rs. 1473/-.From this commuted pension amount Rs. 491/- is deducted and monthly pension is computed as Rs. 982/-. And 90% of this i.e. Rs. 884/- is shown as net payable monthly pension, which is being credited to my pension account.
3.commuted value of pension amounts to Rs. 49100/-out of which I have received Rs. 44300/-. So, I am supposed to get balance amount of Rs. 4800/- (49100-44300) towards difference of commuted pension.
    4. I pointed out this and requested for the said difference through the EPFO grievance portal. I was intimated that as per EPS-95 provision it is not allowed to pay commutation amount difference in respect of 2 years weightage benefit.
Is this really true? Can they deduct the commutation amount while calculating the pension and refuse to pay the difference?
