MCA has kept entire corporate on hold. New companies are not incorporating and existing companies can’t file their returns due. On 17 January 2013, MCA changed its drivers of site. Earlier TCS use to manage MCA21, not batten has been passed to Infosys. The site is under transitional stage and hence some problems are bound to occur. We don’t blame MCA for it, because MCA21 has drastically improved filling and compliance in India. It’s a e-governance project, which the government can definitely boast of.

My concern is different. MCA has not given any clarifications waiver of additional fees, whose due date falls between this period. They have extended time limit for filling 23AC/ACA and Cost Compliance Report in xbrl mode. But they have not done the same in case of other forms.

Let us say, if I have changed my registered office on 24 December 2012, I have to file Form 18 latest by 23 January 2013. However, site is non-functional during this time period. Let us assume that site become operational today i.e. 2 February 2013. If I try to upload that form, MCA will demand additional fees.

This is injustice for all corporate. They have been charged additional fees without their fault. MCA should come out with solution to this problem. They must relax due dates of forms which falls due during this transits period. Due date shall be extended to 15 February 2013 or any other reasonable duration for all forms.

MCA shall work out this solution at the earliest in the best interest of stakeholders.

    Dear Team,

The issue is with not MCA portal (Server side) it is an issue with session management (Client Side), If you are facing the issue with google chrome then change the browser into Mozilla Firefox or else Internet Explorer.

You can also resolve the issue with Incognito Mode just type “Ctr+Shift+Delete” if you are using the Firefox browser.

    This is unfortunate .
Who ever is responsible should act immediately.
At least understand the difficulties faced by site users and give relaxations.

Yes I also observ that MCA is not working properly even now also. Processing error is a common thing. To view public documents if the payment is made the docs will come after few hours. Further frequently getting processing error. Don’t Know what to do. Really these problems are occuring only after Infosys took over this. Really wondering why a Company like Infosys cannot handle this properly

Even now MCA is not working properly. Who is to be contacted in this regard. Even ICAI and other organisations are silent. If Infosys is not in a position or competent enough to handle why they should take up this JOB. Even MCA is silent on this. When contacted their Gurgaon office standard reply that technical issue is responsible for this. Can they not take up the matter with INFosys and sort out this.It is really pathetic

Whatever is happening there needs to be a serious warning given to MCA 21 maintenance, since we practioners are loosing a lot of revenue due to this.
Its asking for penalties for no reason of delay from our side.

Success of MCA 21 so far has been possible due to intense support and participation of various stakeholders viz. professionals from ICAI, ICSI, ICWAI , Directors & Authorized representatives of various companies, Authorised signatories of Banks’, Various Investors, Citizens of India and others who
have supported MCA 21 and used the services and provided feedback for improvement which has enabled the program to continuously evolve.

Accordingly, MCA must take care of all and render justice

2 days back I was not able to log into the portal and I raised a complaint with MCA. I am able to log into the portal today but unable to update the digital signature of a director. Consequently I am unable to complete the incorporation process. I lodged a complaint with MCA now.

We started our company formation process, but it could not even reach to first stage and entire work got stuck. Its been more than 2 weeks now, I am waiting for DIN Number to be generated. Because I believe no work can get processed unless DIN Number. Unable to do anything without company formation other than paying rent…. Can anyone help me if there is any other alternate way instead of waiting for website to start function.

I have a name application set to expire on 4.2.2013; if the web site does not resume I don’t know what would be the fate of my client’s approved name, which ROC had approved with great difficulty after 3 resubmissions.

  11. S.D.Verma says:

    Dear Sir,
In my opinon MCA should extend the date for at least one month i.e. uptp 28.02.2013 for filing all forms, annual returns etc. both in XBRl and other than XBRl format. In case annual return in non XBRL form is not filed in time and now those companies are not in position to file their returns after 17th Jan.,2013, they will also have to pay more additional fee just for others fault.
    Thanks and regards.

  12. CA Anand Khandewale says:

Forget about additional fees payable, new businessmen are the worst sufferers as they are unable to commence business in corporate form and still worse placed are consultants, who have to answer to their clients for such delays!! Complaints to MCA are merely acknowledged and no action being taken to resolve the problem. Who’s responsible for the loss of business and loss of professional time? ICSI also seems to have kept mum..so we are left at the mercy of the almighty only!
