MCA Further Extends timeline for Name Reservation / Re-submission for Companies & LLP’s

In view of the situation arising due to COVID-19 pandemic and extended lockdown period, Ministry of Corporate Affairs has hosted revised details of PERIOD/DAYS OF EXTENSION FOR NAMES RESERVED AND RE-SUBMISSION OF FORMS on its website.

Period/Days Of Extension For Names Reserved And Re submission Of Forms Are Further Extended Beyond 31st July 2020.

Details are as follows:-

Description of Issue E-Form Extension of Period / Days for E-Form Submission
1. Names reserved for 20 days in case of New Company Incorporation  SPICe+ Part B Names Expiring in between 15th March, 2020 to  31st July, 2020. The period will be extended by 20 days beyond 31st July, 2020.
2. Names reserved for 60 days for a change of name of the Company. INC-24 Names Expiring in between 15th March, 2020 to  31st July, 2020. The period will be extended by 60 days beyond 31st July, 2020.
3. Extension of RESUBMISSION validity for Companies SPICe+ Part B

In case SRNs last date for resubmission falls between 15th March, 2020 to 31st July, 2020, additional 15 days’ time period beyond 31st July, 2020 would be allowed.

In case of SRNs already marked as NOT TO BE TAKEN ON RECORD, extension would be provided on a case to case basis.

NOTE: Forms will not be marked as “Not to be taken on record” due to non-resubmission during this extended period as mentioned above.

It includes IEPF Non-STP  e Forms (IEPF- 3, IEPF -5 and IEPF-7)

4. Names reserved for 90 days for New LLP Incorporation or Change of Name. FiLLiP or Form 5 Names Expiring in between 15th March, 2020 to  31st July, 2020. The period will be extended by 20 days beyond 31st July, 2020.
5. Extension of  RESUBMISSION validity for LLPs. FiLLiP or Form 5 In case SRNs last date for resubmission falls between 15th March, 2020 to 31st July, 2020, additional 15 days’ time period beyond 31st July, 2020 would be allowed.

In case of SRNs already marked as NOT TO BE TAKEN ON RECORD, extension would be provided on a case to case basis.

NOTE: Forms will not be marked as “Not to be taken on record” due to non-resubmission during this extended period as mentioned above.

6. Extension for marking IEPF-5 SRNs to ‘Pending for Rejection u/r 7(3)’ and ‘Pending for Rejection u/r 7(7)’ IEPF -5 In case SRNs last date for filing e-verification Report (for both Normal as well as Resubmission filing) falls in between 15th March, 2020 to 31st July, 2020, would be allowed to file the form till 30th September, 2020.

However, for SRNs already marked under ‘Pending for Rejection u/r 7(3)’ and ‘Pending for Rejection u/r 7(7)’, the extension would be provided on a case to case basis.

Note: Status of IEPF-5 SRN will not change to ‘Pending for Rejection u/r 7(3)’ and ‘Pending for rejection u/r 7(7)’ till 30th Sep’20.

    We have applied name in march for an LLP and it got expired in June starting, may I know how can I use the same name as per this notification for registration, because in fillip it was saying expired, if any one has any suggestions could you please let me know.
